damian trujillo joins us from that memorial with the details. damian? >> reporter: raj, these are the names of the 142 men before fro san jose who were killed or missing in action in vietnam. this incident has sparked a new level of community activetism. vandals doesed the sons of san jose memorial with acid. >> you just don't think people will do things like that to a memorial. a place of solace. >> reporter: first volunteers restored the memorial, now the foundation is raising money to put a protective film over memorial and install surveillance cameras. some people in law enforcement are spending their free time looking for the vandals. >> there's eight guys i went to high school with and guys that i played sports against. >> reporter: the effort has sparked donations big and small from silicon valley titans like google to this eight-year-old girl. >> that one really warmed our heart. >> reporter: moved by news coverage of the valentine's dayism, bella put up a lemonade stand and delivered a check to the foundation for $200. >> it was incredible. and

we have more with damian trujillo. >> reporter: the next board member meeting isd one will hav remotelyecause of the restraining order. he has every reason to fear the board member. >> i'm the trustee. >> reporter: the trustee and superintendent stood before the judge today, hoping to explain their sides of the story. it all surrounds an alleged threat. the superintendent says tranthreatened h tran threatened her with violence. he threatened to quote, kick her expletive and put her in front of a firing squad. tran denied threatening her with violence. >> she turned it into a circus. >> reporter: but she felt the threat was real and that's why she filed for the temporary restraining order. today's ruling means tran cannot be in the same room with unless a police officer is present. >> i fear for my physical well-being. the most important thing that i want to say to you is that we're not going to tolerate any kind of violence in the east side anymore. >> reporter: parent activists who showed up in court described tran as bombastic, even confrontational and say he's threatened them too. bu

i'm damian trujillo, nbc bay area news. >>> a mistrial in the case of a fremont man accused of trying to help a terrorist group. adam shafie was arrested back in july 2015 while trying to get on a flight from sfo to istanbul. investigators believe he was headed there to join the organization. it was shafie's own father who alerted investigators the year before when he disappeared during a family trip to egypt. he feared his son was being recruited. no word on if prosecutors will attempt to retry shafie. >>> it was a bizarre case that police initially called a hoax. you might recall a vallejo woman claimed she was raped, then kidnapped, then taken hundreds of miles away. now the man convicted of kidnapping denise huskins in a federal plea deal is back to face state charges which will include rape. he'll likely be allowed to directly cross-examine his victims. he's acting as his own attorney. nbc bay area's jodi hernandez joins us with now with this latest twist. jodi. >> reporter: raj, it's a twist that's caught even prosecutors off guard. matthew muller is gearing up for his prelimina

right now i'll show you our colleague, damian trujillo, talking with one of the parties involved in this restraining order request. can tran, the trustee who the superintendent is seeking a permanent restraining order against because of something that happened in a closed-door meeting. that request was not granted today. instead it was continued to another date, we're talking about a court date of october 29th. so we'll keep on top of that. but the superintendent and the trustee were before that judge. trustee can tran, who you see there before you, is accused of harassing superintendent bauer in the closed-door meeting related to district business. he allegedly threatened to kick your [ expletive ] and referenced a firing squad. trustee karen martinez also alleges harassment and says she hopes this will send a message. tran does not dispute what he said, but told the mercury news that he was mischaracterized in what he was trying to say. he has not been alone in his criticism of the superintendent. others question bauer's management of the school district. bauer, though, is very popular
