damian trujillo has the story. >> reporter: we learned that the official cause of death for this little asphyxia do to suffocation and the medical examiner has ruled it a homicide. authorities made that ruling when they believe a death is caused by the actions of another person. it doesn't necessarily mean anyone will face murder charges, however, we do know the victim's mother was arrested and remains in jail without bail. the girl was brought to the church last september, believing she was possessed by a demon because she would sometimes wake up screaming or crying. the three family members held the girl down for seven hour, repeatedly forcing her to throw up in an attempt, they say, to rid her body of the evil spirit. the mother did not attempt to call for any medical help for at least two hours after the child died. when police arrived, they found the girl with multiple injuries around her face, neck and chest. san jose police declined to discuss the case, saying it remains under investigation. at the hall of justice, damian trujillo. >>> there are new questions about student safety

nbc bay area's damian trujillo joins us live from san jose city hall where the mayor is calling for more help for officers that may be struggling with addictions. >> jessica, it's been a rough week for san jose police. first that story about a san jose police officer died of a fentanyl overdose. and now this latest news that a san jose police officer was drunk on the job while he was in uniform. the problems keep piling up for them. in the most recent case, sources tell us that an fbi agent reported the officer after he appeared intoxicated when he showed up in uniform to investigate last week's kidnapping. we're told the officer was given a breathalyzer that registered a 0.139 blood alcohol level. that's nearly double the legal limit. that officer is now on administrative leave pending a criminal investigation. the news comes just days after we broke the news about the fentanyl overdose of fellow officer de'jon packer. today the mayor proposed random drug and alcohol testing for all officers. >> it's apparent that this needs to be made universal in the department. doing so will enable t
