dan: this is really interesting and tricky waters. let's say feinstein does step down for the sake of argument, what happens then? reporter: if that does happen, governor newsom would then be tasked with appointing someone to fill out feinstein's term just as he did when vice president harris vacated her senate seat. what complicates things this time is we are in the middle of a robust grace already to replace feinstein. one democratic spoke to today said because of that, newsom could choose to appoint a so-called caretaker candidate, someone who would fill out the term but not seek election in 2024. we will see. ama: the judge has scheduled another court date to set a trial date for the man accused of attacking paul pelosi. david depap is due back in court on june 14, when the judge will determine when the trial will start. the charges against him include attempted murder, elder abuse, and assault with a deadly weapon. he's already facing another trial in october on federal charges. he's pleaded not guilty to all charges in both case

dan: thank you. a tragic shooting that led to the death of a five-year-old girl is still under investigation. it happened on 880 while the family was on their way to dinner. zach fuentes has more on what we know. >> five-year-old eliana have turned six, but now her family is mourning her death. the family was on their way to dinner on saturday before 7:00 p.m. along 880. a vehicle pulled up and someone started shooting. a bullet hit her. >> we had an officer on an unrelated traffic stop on the side of 880 in the fremont area, approached about 6:40 p.m. by the victim's family. they said their daughter had been shot. the five-year-old girl, she was transported to a local area hospital and succumbed to her injuries. >> right now, we still don't have suspect information. this was one of two separate shootings at multiple agencies across the east and south bay. before the deadly shooting that killed her, fremont police heard from a pedestrian who said a car pulled up to them and shot at that person after
