we dig in with jon karl and dan abrams. jon, let me begin with you right now. looming over this whole thing is whether or not the president and his team will try to prevent comey and his team from testifying by invoking executive privilege. >> i have talked to several top aides saying there is no plan to do that. they believe it would be a tough case to make legally. and politically, it could be a disaster. that said, there's though telling if the president will decide he wants to make that fight later on. right now, the -- the opinion inside the west wing is that comey will testify. they'll not try to stop it. >> what is the white house strategy for taking on what is certainly going to be blockbuster testimony on every network? >> it will be. there is clearly a sense of that here at the white house. but, george, for all of the talk of setting up a big war room in the west wing to deal with this, none of that has been put in place whatsoever. you saw corey lewandowski and david bossi, veterans of the campaign, have been here at the white house. i'm told neither

let's bring in abc news legal analyst dan abrams. dan, he joins us on the phone.an, what do you make of this outcome? >> well, this was a tough case from the beginning and i think a lot of people feared that there could be a hung jury here. because, remember, even if these jurors believe that it might have happened or probably happened, just as andrea constand laid it out, that's not enough for proof beyond a reasonable doubt. and as linsey just talked about, this is always been viewed as a tricky case but, look, you got to give these jurors credit. the fact that they tried for this long to reach a verdict is unusual. meaning they often if friday morning jurors don't have a sense of that they're going to have a verdict by friday afternoon, you usually let them go. these jurors kept going and going and going and trying to reach a verdict, simply unable to do so. >> we know the jury consisted of seven men and five women, dan abrams, we really appreciate your analysis on this breaking news as we look at bill cosby at the courthouse there in norristown, pennsylvania.

i am here with legal analyst dan abrams. first, he claimed to measure vindication saying that james comey confirmed publicly that the president wasn't under the russian investigation and there was no evidence any votes were changed. >> and that's true. the problem is he's quoting comey as the ultimate and definitive source in certain places and shifting when they don't like what he said to calling him the ultimate liar and then a leaker. you have three things that they're talking about him. believe him, don't believe him and he's a leaker. >> saying comey is not telling the truth when he talks about the january 27th dinner when in his words the president said i expect loyalty from him and secondly, quotes about the february 14th meeting where he believes that president trump directed him to let the flynn investigation go. >> let's be clear. they're calling james comey a liar. they're saying he's lying about this. there's no middle ground here. he's not saying he may have misremembered it, yes, there were discussions about lo

dan abrams, what do you think? >> it's still unclear.es comey did make one thing clear which is that he was directed, in his view, to end a portion of the investigation with regard to michael flynn. >> reporter: flynn is the nsa director trump ultimately fired after it was exposed that he lied about his conversations with the russian ambassador. comey says the president privately asked him to go easy on flynn. >> i took it as a direction. this is the president of the united states with me alone saying, i hope this. i took it as, this is what hadn'ts me to do. i didn't obey that, but that's the way i took it. >> the president wanted to speak to him alone, which in and of itself is an extraordinary thing. that doesn't happen very often. and the reason from listening to jim comey's testimony, the reason was because the president understood what he was going to ask was something he wanted to keep secret. people keep things secret when they have guilty knowledge about it. >> reporter: comey made it clear today that's not how the fbi normally

we'll bring in abc news chief legal analyst dan abrams.ow difficult is it going to be to seat this jury. >> not as difficult as his attorney would have you believe. most people don't know who he is. the bottom line is his attorneys make it sound like anyone who walks into the courtroom of course knows who he is. a lot of people don't know who he is. the greater danger, i think, is that the people who do hate him not make comments in front of other prospective jurors because then you have the risk of tainting the entire pool of people who are there so that's the real challenge for the judge which is containing the very passionate comments that certain people may make about him and making sure that it doesn't affect the rest of the jury pool. >> you know his lawyers already called for a mistrial citing the received. lawyer has said don't believe everything he said on social media because some of it is so unappealing and so unhelpful to him in the context of this case the notion that it's the media that has been the problem, the fact that the

i want to bring in dan abrams. on this issue of michael flynn, the alleged request we heard about in the oval office. saying to comey, i hope you can let it go. comey pressed on that today. the president saying i hope, not i order you let it go. here's the moment comey was pressed on that point. how do you take it, dan. >> well, look, i think the way james comey took it is fairly clear, he took it as a dire directive, an order from the president and it's an order that he said that he would ignore. why didn't he do something about it? he didn't want to derail the russia investigation. a bit of a bombshell, they specifically left open the possibility of investigating the president himself for that comment down the road. >> on the issue of james comey leaking his own memos, it happened. the white house now targeting comey about the leak, does he face anything for this? >> well, certainly face criticism from some, secretly leaking to someone. it's not a crime that it wasn't classified. he specifically wrote these memos

let's bring in chief legal analyst dan abrams. dan, andrea constand may testify as early as today but as we just heard in linsey's report that other accuser took the stand yesterday. how important was she in this case? >> she's critical because, look, we know the potential problems with andrea constand's testimony which is it took her a while to report it. there are inconsistencies in her story, it happened a long time ago, et cetera. if the jurors believe the other woman they look at andrea constand's testimony in a completely different way. if they believe her then everything andrea constand says may ring true. everything andrea constand says may be viewed through giving her the benefit of the doubt. without that, it's just andrea constand on her own and whether these jurors believe her or not. >> we heard in lindsey's report the defense pounced on that other witness. is that risky? >> it's always risky, right, when you have someone this tears on the witness stand talking about what she says happened to her and a horrible experie

let's bring in dan abrams. dan, always great to have you. this notion that the jurors would enter that room a nonbinding vote all of them saying not guilty then over the course of six days 10 out of the 12 would decide guilty. >> it's typical for jurors to take a straw vote when they come in and say where does everyone stand and everyone sort of raises their hands. that's part of the deliberation process. it's not a binding verdict that's not a ruling and doesn't happen until the verdict form goes in. what's astonishing here is that you had all of them saying not guilty and then as the deliberation process went on 10 -- this is out of a movie. this is like "12 angry men" the other way. i've never heard of something like this where 10 of the 12 jurors apparently changed their minds to the point from where they were ready to convict. >> tiny room, not even room to pace, this juror apparently said but fists into walls. this could come up again. >> look, i think that you can expect the defense to file a motion and say, look, they were ready to a

let's bring in legal analysts nancy grace and dan abrams to talk more about this.completed her testimony. how do you think she held up during cross-examination? >> look, it appears she held up very well. if she hadn't, this case would be over. if she hadn't been able to withstand tough questions, there would be no chance of a conviction in this case. look, there are inconsistencies in her story. there are problems, and this was the time when she was going to be able to answer them. and as a result, i think that the prosecution still has a real shot here. >> nancy, overall, how do you think she did in terms of her testimony? >> at first i was very concerned about the cross-examination regarding the dates. she had her dates mixed up. but when i look back at her testimony, she did incredibly. and the more i listened to the testimony and the more i read about this case, i think it's going to strike the jury the same way. it brings back all the rape and sexual molestation cases i tried where the victim has such a feeling of helplessness and powerlessness. it's overwhelm

our chief legal analyst dan abrams is joining us now and, dan, that video is kind of scary to watch andomebody was in a car in that condition. but he passed the breathalyzer test and admitted to taking some prescription drugs. we saw the dash cam video. how does that affect his case? >> on the plus side he was cooperative and turns out he told the truth. on the not so plus side is just about everything else on that video. you watch him on that videotape and that can be used against him to show that he was driving under the influence. people sometimes think, oh, well, it has to be alcohol. not true. as you know i host the show on a&e called "live pd" and watch police departments every night we see people pulled over for dui and every night the police officers have to decide, is this a case where it's alcohol or is this a case where it's drugs and, in fact, there's a different kind of test they often do when it's suspected drugs, so the bottom line is just the fact that he passed a breathalyzer doesn't get him off the hook. >> what kind of punishment could he face? >> he could face anythi

i'm here with dan abrams. our chief political analyst matthew dowd and you saw, dan, let me begin with you. corey lewandowski pretty much doubled down accusing james comey of perjury. the president used the word lies this morning as well. this is now almost certainly in the office of the special counsel. he'll be asking the questions now and big question is who will he find more credible and do the president's actions add up to obstruction of justice. >> that was a heck of an interview but in the question of obstruction of justice, i think if you were to ask james comey, what do you think, he would say, that when i was directed to end part of the flynn investigation, i didn't think it was obstruction of justice at that point. even until the time i was fired, i didn't think it rose to that level. but i think if you were to ask james comey in a private moment what do you think now? i think he would say the fact that i was fired over the russia investigation in an effort, i think comey believes, to affect the russ
