let's bring in chief legal analyst dan abrams. wasn't so sure, dan? that judge was not having it.e. remember, prosecutors asking for eight months. the defense asking for a month behind bars. the judge coming back with an 18-month sentence. very unusual to see that kind of disparity between what the prosecution has asked, what the probation office has recommended, what the defense is asking for and ultimately what the judge ends up doing. >> how much did all this new evidence, that we're just now seeing, how much did that play into the sentence? >> i think a lot of what played into it was the sense from the judge that she still is not fully coming clean, right? even the judge asked a question during the proceeding, suggesting, and the prosecution mentioned this, that she's continued to lie about it even after the plea. and i think that's the sort of thing that will really rankle a judge. when you're pleading guilty and supposedly accepting responsibility for what happened, yet in other places, with friends or family or whoever else it is, you're continuing to claim it didn't happen

let's bring in chief legal analyst dan abrams. art out by explaining to everybody why even though steve bannon was pardoned, he can be charged again. >> talking about state charges versus federal charges. the pardon occurs with regard to the federal government, the department of justice. but that doesn't mean that you're pardoned with regard to any potential state charges and that's what we're talking about here. now, the problem steve bannon has with regard to the politicization defense, this is all politics, is that the victims here were all people who were so committed to building a wall on the southern border that they were willing to donate their own money. some of them with not a lot of money offering $10, for example. they raised $25 million from all people who were so committed to that. these are all conservatives who believed in that cause. that's number one. number two is it was the trump department of justice that indicted bannon, not the biden department of justice. the trump department of justice under bill barr and fi

let's bring in abc news chief legal analyst dan abrams. dan, these are very serious charges. bad is this for donald trump and how hard a case is it to prove? >> yeah, look, there's no question the details are damning when you read through the 220-page document. it's not a good look for donald trump, but legally i would say there are two buckets. number one, the advantages that she has, the things she can really use are the objective facts, right? you heard the reference to 30,000 square foot estimation when actually it was 11,000 square feet. that's an objective lie or an objective misstatement, right? that's very significant. that's different than valuations, right? so i think you have to separate out the things they'll be able to prove definitively and the most important thing is going to be able to prove that he knew what he was saying wasn't true. so there are going to be witnesses and documents. the harder part is the the valuations because the defense is going to be, wait a sec, these are banks, insurers, they check the numbers themselves. how can you possibly blame me?
