dan says it could get worse and one of the biggest names in the group reports next woke. walk us through, dan. >> pepscy is reporting talking about consumer staples here this is kind of an interesting conversation right after that retail one you know, consumer staple stocks have the worst performing secretary ner the s&p right now down 3.5% on the year. the xlp, the etf that tracks the sector is made up different than the xrt. the top five stocks make up eye% of weigh pepscy coke, proctor and gamble, phillip morris and wlrnlt process. all i've stocks act badly .best on the year is unchanged on the year the worst one phillip morris is down 23% on the year i'm not holding my breath for any of those names to report q 3 earnings and drag this sector up lab. so i thinks pepscy how it reacts next woke the options market is not complying a big movement 2% in either direction. but how the stock reacts how investors take it could be interesting. earlier in the year the group was volatile input costs went higher you know and margins were pressed a little bit this group trades expensive to the broad market here. so as i think about the chart and the technical setup here, look at this uptrend since 2011. it broke it earlier in the year when things started to getted about. just got rejected there. i want to play over the next couple months or so for a move back below 50 bucks here so very specifically, the trade when the stock was trading at 53.85, the xlp you could simply low back out to november expiration by the november 54 put paying 90 cents. they brake even at 53.10 down 1.5%. that's the max risk. one of the things interesting when mike talked about the equal weighted xrt and why to sproid it there is not a lot of risk when you have five stocks making up 50% of the weight there is where you want to let it run a little bit i'm in the money on the 54 strike and i want to see this thing start moving back down closer to 50 and at some point i may spread it by selling a lower strike put in november to make a vertical put spread. >> yeah, you know it's interesting, again, the he was engs ming he didn't use a spread here the xrt is more volatile than this particular one is and you'll notice that actually this option costs about as much as a spread in the other which is why going ahead and buying that put outright also makes a lot of sense we obviously have the upcoming earnings season in here. as he mentioned you have a halve of stocks that could make it move around a decent amount and the options are cheaper which justifies the structure. >> as a setup goes, the key thing from my seat is what dan showed on the skroen there which is a long assent and then initial breck, followed by a throwback to the point from which it broke that historically is a very bad situation to be in you've had a lot of volatility -- remember the beta of the staple as a sector is.82. more volatility really than the market of late in a dormant asset that breaks and recovers the likelihood of failure here is high. >> does the outlook change, dan if the markets break down if you see a pullback in the markets is there a safety trade. >> it's funny i'm not worried about that preponderates is the one thing we didn't talk about, right. a lot of the names we talked about that make up the big weight have great are than 3% dividend yield we know with the 10 year back above 3% that's one of the reasons they have lost luster but i don't think that we're in a position where if the market is higher these stocks are not going to perform they're the worst acting in the broad market if we go lower i expect them trading

dan simon is in phoenix. dan, who are you talking to, what are you hearing? >> reporter: well, hey, brooke. as you can imagine, the reaction has been decidedly mixed. the most visible reaction has actually been outside of jeff flake's office in phoenix, where we saw a number of protesters outside of that office. they have been there for the past 24 hours, a lot of women dressed as hand maids, wearing the red dresses and white bonnets. when the word came out this morning that jeff flake was actually going to support judge kavanaugh, we saw their moods totally deflate. and then when we saw this one-week delay, the mood changed a bit. here's what some of those protesters had to say. take a look. >> i saw him being confronted by the women when he was in the elevator, and thought he was a little bit in a pickle. so i'm happy to hear that he's agreed to work, putting forward the idea of the seven-day period. we'll see. >> flake is under a lot of pressure from all sides. and i think he's trying to play all sides, really. because he always votes for trump. so if he really disagreed with trump's positions or his mannerisms, instead of just complaining about his manners, he should vote against him. but they have made a deal with the devil. >> reporter: as we know, jeff flake has been a polarizing figure in the state of arizona, with many republicans upset over his criticism towards president trump. once again, he finds himself in this place where he's not able to please really many people on either side. i've seen some people remark, brooke, he's now occupying the space of his colleague, the late senator john mccain, where people have now -- are now saying he is now acting like a maverick. brooke? >> dan in the senate, republican senator susan collins, is from. she says she is still undecided how she'll vote on judge kavanaugh. she's also been targeted by anti kavanaugh protesters. this is a scene inside her portland, maine, office. officers were called in after a crowd of people were marching inside. kaylee hartung is there for us. and what's been going on? >> reporter: brooke, just as you're seeing those tensions high in washington, or in arizona, we're feeling those here too in maine, just outside of senator collins' office here in portland. you can see the cop cars behind me. those called to help keep the peace in senator collins' office earlier today. there was a group of women who had hoped to organize a sit-in for maybe 15 or 20 women today. but hundreds showed up. senator collins' staff inundated by this large volume of people, really wanting to share their concern, their frustration and their objection to brett kavanaugh. you heard shouts like, "all of maine is waiting." they

>> it sounds like papadopoulos was not part of collusion but a set up. there are three key set ups her here. and with specific regard, what's fascinating about this is, are we interested anymore about following the evidence, or have partisan blinders made us -- the interaction has -- is not what the media made it out to be. and no evidence has been produced to refute this. there was no offer of emails, it was simply a statement. however untoward it may have been about having russia emails, that's fine. no evidence has come up to the contrary, was apparently ever made available at all. one more thing. the lawyer and his associates,y are photos out there to prove it. i wish people could look at the evidence and not conjecture. >> it would be great if people would look into that as well. it just raises a lot of questions and there were several of these papadopoulos interviews this morning. listening to everything he says, the question that rises for me over and over is, why were these people suddenly popping into his life? i know he was on the list of foreign policy advisors but suddenly there is a ton of interest in him and everyone is putting in front of him very tantalizing information to try to see, it feels like it, if he would take the bait. >> the answer is, at that stage of the trump campaign, we have to put ourselves back to where we were. a lot of the more elitist foreign policy, and i don't mean that in a bad way, but elite foreign policy advisors who sadly at that time had avoided the trump campaign. and and mr. george poppel papadopoulos was not up one of those elite guys and he was an easy target to set up because he hadn't had this experience in the arena in the past. the set up narrative is very credible if you look at it. >> martha: i do want to ask you about what donald trump jr. had to say about the fallout at the white house. after this op-ed appeared from a disgruntled senior administrator official. he says the circle is getting very small of trust. watch this. >> i think there are people in there that he can trust, it's just a much smaller group than i would like it to be. >> who do you trust? >> i will keep that to myself. >> and they are not family? >> outside of family, i think that goes without saying. >> martha: what do you make of that? >> it sad that it comes to this. we have a duly elected president of the united states you are free to disagree with or not. he can't even get advice from an elite bunch of people out there because they don't trust anyone and this op-ed was just a cowardly, really despicable act. martha, i don't speak with forked tongue on this, i don't look for anyone's applause line but i resigned my job as a secret service agent when i left under the barack obama administration. i had no personal dislike for barack obama, i just felt like the country wasn't headed in the direction. this person who brought this up, he should do the brave thing and not the cowardly and resigned. but i don't blame them for shortening up or tightening up their circle. it's clear they can't trust anyone and it's clear the media will print this kind of stuff to make them look bad. >> martha: it before i let you go, gary cohen and rob porter both came out today with statements basically saying that they loved working in the white house, that they felt that the portrayals of them in the woodward book were misleading. obviously, they are in a difficult position and the word is that the president is very unhappy with them. you do have to ask yourself, if this book has been created to push of a certain narrative, or, was he really open about everything that he was told? (ken)bart station agents say they are working in fear of being attacked at any given time on the job(on cam)the concern for safety is at an all time high at the macarthur bart station where a bart employee was attacked over the weekend. (pam)today kron4's (pam)today kron4's haaziq madyun spoke to the station agent's representative about what they say is lack of safety once they step out of the booth(take pkg) (pkg)sotsafiyya taha-shaheed is the union representative for bart's 309- station agents. she says of the transit agency's stations, the macarthur station in oakland has become one of the most dangerous for passengers and station agentssotthat violence includes the july 2018 stabbing death of bart passenger nia wilson and this pastabor day weekend's assault of one of shaheed's fellow station agents who was struck from behind while trying to assist a pair of female passengerssot she says since it is against company police for station agents to carry any sort of weapons for their personal protection, bart police should handle the jobsotespecially at this bart station...sot shaheed says the injured station agent is recovering from the assault and that bart police are checking the macarthur station's surveillance cameras for any leads for a possible suspect...in oakland haaziq madyun kron4news (pam ) tonight... we are learning more about a deadly plane crash on the peninsula. a plane transporting a mother and her daughter to lucile packard children's hospital at stanford .... crashed today near the palo alto airport. both passengers were injured. the pilot, a volunteer for a non-profit that provides transportation for those in need of medical care... died in the crash. kron4's terisa estacio joins us live now from palo alto -- with details on what happened. terisa. an air safety investigator with the ntsb just held a briefing... he gave us the very latest on the crash involving that plane... as you can see it is still there in the marsh here near the palo alto airport.... (take pkg) michael huhn, ntsb. preliminary findings show that in the in bound landing, the pilot reportedly bounced the plane, and he opted to go around and that is where he crashed. the small plane had three passengers aboard... fire fighters say they received the 911 call tuesday morning and rushed to the scene - which was about a quarter mile from the runway. huhn. the mother daughter were on their way to stanford. eve philipson, flight instructor. i was in flight and i could tell he did not know the runway. steve philipson, a flight instructor says he was listening to the exchange between the tower and the pilot, who has not been indentified. steve. a colleague says they saw the plane hit the runway, hit the propeller, then try to come up but couldn't - didn't have the energy, and crashed. kron four has learned the pilot was a volunteer with angel flight... an organziation that flys people in need to medical facilities. the plane orginated in redding, and according to a spokesperson with angel flight was taking two females to the lucille packard childrens hospital for medical care. steve. it is a crushing loss. aviation is a tight group. i did not know him personally, but it is painful and upsetting. (estacio live) ntsb says they are hoping to get the plane out sometime tomorrow. te ntsb is hoping to remvoe the plane sometime tomorrow... (ken) homes and campgrounds are being evacuated because of a quick-moving wildfire in placer county. officials say the flames are rapidly spreading in the tahoe national forest-- near emigrant gap. so far the fire has burned 500 acres and is just 10-percent contained. cal fire says air tankers, helicopters, and strike crews are are assisting the u-s forest service's fire management team. (ken/on cam) halfway through one of the earliest and busiest fire seasons on record, calfire is facing a new staffing issue. as kron four's rob fladeboe tells us... aircraft are being grounded because of a pilot shortage. rob fladeboe/hollister "...the pilot shortage is putting a strain on resources. califire confirming that an average of four aircraft were grounded on certain days in august because there were no pilots to fly them..." calfire confirms it is short on pilots, especially those that fly the s-2 tankers like these here in hollister and other bases around the state. but at no time has that meant delay in responding to fires says calfire deputy director mike mohler.mike mohler/calfire "....operationally, we bring on additional aircraft to fill in to respond as part of our initial response, so is there a pilot shortage, yes, but for response in having aircraft over fires, absolutely not..."yes, calfire says there have been times when aircraft were grounded for lack of pilots. but sometinmes it's just the opposite. fire season is now year round and the aircraft need that much more maintenence and sometimes the pilot can be grounded for safety's sake says mohler.mike mohler/calfire ".....yes, there may be a calfire aircraft sitting on the runway but it's in anticipation of either maintenence or a pilot that's off that day or a pilot that has flown too many hours...."as to what's behind the shortage. many pilots have retired or are about to while others are being lured away by the private sector. flying through steep terrain and smoke to drop retardant on a wildfire is a dangerous job with difficult hours and there has been one death . mike mohler/calfire "....yes, you could say perfect storm, it's a combination of our aircraft not being a seasonal aircraft but rather a year round aircraft so maintenance is a big, big issue for us, pilots are retiring, there's attrition in the fire service and already this summer we've seen the biggest fire in calfire's history..."rob fladeboe/hollister "....going forward calfire says it is looking to hire as many 40 new pilots over the next few years. in hollister rob fladeboe kron4news (pam) new testimony today in a southern california court... regarding a man charged with killing a gay college student.(ken) the testimony may shed light on a motive in the killing... the victim's sexuality is believed to be a possible factor. grant lodes joins us with the latest. today we learned samuel woodward will stand trial for murder. blaze bernstein was killed in january. the university of pennslyvania student went missing after going out one night to a park about 50 miles southeast of l-a. he was found in a shallow grave in the park about a week later. according to investigators, the man accused of killing him, samuel woodward.... was with bernstein in the night he was killed. prosecutors say woodward stabbed bernstein in a fit of rage after bernstein tried to kiss him. woodward, who's 21, told investigators that he was disgusted when bernstein kissed him on the lips in his suv... and pushed him back, but didn't say he did anything more violent. today an investigator testified that woodward had bunch of anti- gay.. anti semetic... and other hateful content on his phone. the violent hate group atom-waffen's insignia was woodward's wallpaper. (philippe) supervisor ahsha safai (ah-shah sahf-eye- ee) represents the cayuga neighborhood near the outer mission district in san francisco... where underneath the bart tracks and interstate 280... for quite some time... up to a half dozen rv's have been parking overnight on de wolf street, which stretches about a block. he says neighbors are upset about it... and, want oversized vehicles banned from parking overnight.... as they are on nearby alemany boulevard and other streets throughout the city.ahsha safai/supervisor- "the idea of people living on a block behind people's homes cause a lot of consternation." safai (sahf-eye-ee) says the rv's have forced renters and homeowners to park in "no parking zones" and receiving tickets.ahsha safai/superviso r- "people have sought to ensure that they have available parking and that they can enjoy the quality of life in their neighborhood. rather than having an rv park and taking up all the parking." cheryl brinkman is chair of the san francisco municipal transportation agency board of directors. she says s-f- m-t-a has heard from supervisor safai and his community... and, says the board is looking into restricting access along de wolf for oversized vehicles. cheryl brinkman/sftma- "if that block were to get any kind of parking change, whether it was an oversized vehicle ban, or a two-hour parking only, or a four-hour parking only, it would have to be passed by the sfmta board." and, that board is expected to take up the issue at its next meeting in two weeks.ahsha safai/supervisor- "and, i think that the sfmta needs to have an in-depth conversation about designating a certain area of san francisco, where folks can park these rv's or have space for them, rather than having this constant conversation of where, what street they can park on and can't park on. and, i think we need to have more thoughtful conversation about where they should actually be located." later this month, if a plan is approved to add parking restrictions on de wolf... the signs could go up immiedately after a decision is reached. in san francisco, philippe djegal, kron four news.
