we are joined by dana griffin and dasha burns. dana, what comes next?plans to challenge this rule again? >> reporter: absolutely and they have another chance on wednesday when the legislature is back in session. they attempted to create a rule to appeal this statute but it was unsuccessful. there is an effort in arizona to get signatures for an initiative to go on the november ballot to try to codify reproductive rights here in the state, so that is ongoing. you've got the attorney general who said she will not prosecute any doctors that perform abortions. we have spoken to many people on the ground that are now galvanized because of this particular issue, hoping to make their voices heard come november. listen to what they said about the entire ruling. listen. >> the right decision. was a decision based on statutory construction. the judges did what judges do. they deferred to the policymakers to decide the policy. >> to have the government try to step in and choose things -- the 1800s is on the surface ridiculous but it is very hurtful to a lot of peo

. >> correspondent dana griffin is in tucson for us today, so, dana, specifically, what are we expectinghear from the vice president? >> reporter: yeah, kate, we are expecting her to essentially slam the former president donald trump for what she calls his role in this health crisis, she goes on to say that donald trump is the architect of this health care crisis, and that is not a fact he hides, and that, he brags about it. she goes on to say that here's what a second trump term looks like. more bans, more suffering, less freedom, but we are not going to let that happen. well, donald trump himself is also weighing in on this issue, he has sort of flopped on this issue before, he said earlier back in the '90s that he was wrote choice but that dehid not like the concept of abortion but even today or earlier this week, he says this issue should be left up to the states and he's doubling down on that stance, saying on truth social today, the supreme court in arizona went too far on their abortion ruling in acting and approving an inappropriate law from 1864. now the governor and the arizona

>> let's bring in nbc's dana griffin in scottsdale, arizona, along with claire mccaskill, former democraticator from missouri, and brendan buck, former press secretary for house speakers john boehner and paul ryan. dana, this law in arizona is currently on hold for 14 days. arizona's a.g. has said she won't enforce it, so what is the impact being felt on this ruling so far? >> reporter: yeah, ana, it is sending shock waves throughout the state of arizona. many people angered, saddened on both sides. we spoke to voters who say that they will be galvanized, and this will impact them when it comes to november because they want their voices heard. there's a group now that is collecting signatures to try to get an amendment, an initiative on the november ballot so that they can try to codify reproductive rights in the state and many people say this will get them out to the polls because this is an issue they really care about. so right now the law is on hold because it's being sent back to the lower court. they will look for additional constitutional challenges, and then that's when the process

dana griffin has the latest claims from his legal team and the reaction from the family of one of his alleged victims. >> reporter: an alleged alibi revealed in the deadly stabbing of four university of idaho students. madison mogen. xana kernodle included. his attorneys seay kohberger wa out driving to see the moon and stars. they say in a statement, we are not sure why it has taken over a year to come out as these don't appear to be complicated activities, the family says. it's the same defense the judge questioned last year. [ inaudible ] no witnesses were included in the filing. kohberger's team will rely on analysis from a cell phone data expert. >> could this help or hurt his case? >> i think they had to file the alibi. i think they know it is a tough alibi. he's not arguing that he was hundreds of miles away in another state. he's not arguing that he simply wasn't in th was in the area, just not specifically there. >> reporter: but last january, police say cell phone data showed kohberger was attempting to conceal his location. his phone was turned off from 2:47 to 4:48 that mo

nbc's correspondent dana griffin has the details. >> reporter: arizona republican lawmakers were successfullly banned this 1864 law. lawmakers will likely try again starting on wednesday, when they are back in session. this issue is galvanizing people in arizona saying they are going to take the fight all the way to the november election. there is now an effort to get signatures so that an initiative will make it on the ballot, which will codify reproductive rights and the access to abortions here in the state. right now, this ban has not gone into effect because it takes about 60 days. right now, the lower courts are dealing with the potential challenges to this rule before it actually goes into law. that would ban nearly all abortions in the state of arizona, except if it were to affect the life of the mother. that could take effect in about 60 days, when it comes to november. we have spoken to so many people who say this is galvanizing them. they are now in a position to make their voices heard, and they want this to end up on the november ballot to where they can protect reproductive ri
