joining me is msnbc legal analyst danny cevallos, and good morning to you.thee have to choose or can she do both at the same time? >> she doesn't necessarily have to choose. in all likelihood, she will cooperate with the investigation. because it does put her in an uncomfortable situation. but this investigation does that to a lot of different people in high levels in both the cia, the fbi, and other law enforcement agencies, within the executive branch. but the key here is that durham is part of a team investigating, using u.s. attorney, federal prosecutors, intelligence community activities, overseas. so that creates a natural tension because this is normally done by the intelligence community itself. federal prosecutors applied different standards, they're in the law enforcement business, so that alone creates an awkwardish situation whenever you have federal prosecutors, used to investigating domestically, conducting investigations or communicating with intelligence agencies abroad. >> you know, danny, on that same report, it says that durham is focusing
