so joining us right now, msnbc legal analyst, danny cevallos. danny, good morning to you. you for being here. so the senate rules for impeachment trial also have a history section that says quoting here, the chief justice has voted in the case of a tie. what sort of scenario would that play out? >> historically, it's happened twice. simon chase did it in the impeachment trial of andrew johnson, and there was some objection at the time. i'm going to throw some more controversy into the fire here. look at the original text, the constitution. article 1 section 3, first the senate has the sole power to try impeachments. second, the vice president only participates in the senate, has no vote unless there is a tie. and thirdly, the only mention of the chief justice is that he presides. with those three parts of section 3, appears that even though the chief justice presides, the constitution may mandate that the vice president is the only person who can break a tie in the senate. now, of course there is precedent in prior impeachments as professor tribe said. there have been vote
