trying to track this man down. >> danny and nick. as i understand it, he also has a criminal record in the state of tennessee. what more can you tell us about that? >> yeah, very violent streak and a violent list of offenses for johnson. it was back in 2016 that he was convicted of the murder of a friend who posted on social media in just four days later, was found buried in a field with more than two dozen stab wounds after he was detained and taken into custody, he had another run in with an inmate and tried to kill that inmate, according to authorities. pleaded guilty to attempted first degree murder after trying to kill that inmate with a brick, repeatedly striking him in the head. not only that, he set fire to the shelby shelby county jail in tennessee not once, but twice. so this is a man with a violent streak, and authorities are very concerned. they call him desperate and violent, and they're very worried that he's on the run during christmas. they say this is a time when people tend to be more generous. they tend to let thei

what does danny say at that point?ned because the way in which they got to that second count was unprecedented. because of the fact that we are not supposed to encourage a compromise verdict. if you have a deadlock jury you don't want to tell them, we want you to agree to go with the lesser count. it is set up that way so that it doesn't happen but unfortunately when the district attorney went out of their way to give the jury another bite at the apple. they removed it with the help of a judge, removed that top count to get to that second count. once they got there, we of course had concerns now that you will either have a deadlock jury on that count as well or if you have someone who is considering a guilty verdict on the top count, they very well -- whelp may consider a guilty verdict on the second. at that point we felt the best we could do was a hung jury but we didn't know and we did feel that there was some interplay here as far as understanding the links at which this district attorney's office would go in order

all right, danny, thank you very much. and all of that, you know, significant detail there from danny's reporting. joey jackson joins me now. criminal defense attorney. so, joey, okay, i want to get your reaction to some of the details that danny had there. first, though, when he's talking about the charges, first degree murder. you know, to sum just you look at this and you go, a guy comes and assassinates someone on the street on video in the streets of new york. that's first degree, but it actually in new york state, things are different. it was second degree. yes, they get to they get to first degree because they say that this was intended to terrorize. yes. and so do you think this is a very, very high bar, right. i guess it means he can never life without parole. no way around. it. is the da going to get a conviction on that? >> so this is what they're doing. what da generally do is they charge number one, the conduct that's relevant to the offense. >> and number two, they charge what they can prove beyond a reasonab

let's bring in legal analyst danny cevallos. not waiving extradition, bail denied.w? >> extradition is going to happen. the uniform extradition act requires that the governor must turn over a fugitive to the requesting state, which in this case is new york. although because pennsylvania has charged him with their own crimes, the lead charge being an f-2 forgery and an f-3 firearms charge, in theory, pennsylvania could keep him, but they're not going do that. it's up to the governor. governor shapiro will surely turn him over to new york, but the defendant himself can put up a fight. he can file what's called a writ of habeas corpus if he wants to oppose extradition. he can challenge the legality of his detention, but this is going to happen one way or another, which is why most folks will waive extradition. you saw it in bryan kohberger, who was also apprehended in rural pennsylvania. waive extradition, get back to the requesting state and start the case, because i'm sure his attorneys told him it's a foregone conclusion, extradition is going to happen. >> danny cev

danny, you actually saw him? you were there and saw him going in. you know what what was he like there? i mean, you can imagine, obviously the cameras and the lights and all of the press and everything there as you saw him, what was his demeanor like and where? what is the very latest that, you know here coming out of this important press conference sure thing. >> erin. >> well, i'll say just about an hour ago, i was there inside that courthouse, watching as luigi mangione walked right past myself and a number of other reporters. he was wearing a blue shirt, blue jeans. he was, of course, handcuffed, and he looked, even in this court appearance visibly distressed. but he kept his brow furrowed through the duration of this arraignment hearing. and i should say what was interesting, though, erin, as you said, we haven't heard a statement from the suspect. he did actually speak inside of that courtroom to the judge and to all the folks who were in there. but it was on very selective issues and i'll just kind of go through what we heard. the judge asked
