danny cibolo's. danny, welcome in. i don't think i've heard a judge put it so plainly before. we've seen trump do this for decades, really manipulating the legal system to his own will. how rare is a judgment like? this >> it's very rare, for the most part, there are plenty of lawsuits that are on shaky grounds, but rare is the case that is so frivolous that once sanctions. there are rules that address sanctionable conduct and frivolous lawsuits, there is a rule called rule 11 that all lawyers, know that if you sign your name to a plea deal and has no grounds, then you subject yourself to possible punishment. but it is not used all that often. we've thrown at all the time. if you don't withdraw your lawsuit, i'm gonna seek rule 11 sanctions, but the reality is, only a tiny fraction of these cases actually get sanctioned by a judge, i think the judge got it right. there appears to be a strategy that trump does not appear to really care about the outcome of these lawsuits. they are used as political capital so that he can violate and then go to a speech and say, well i'm going after them, i am suing them, and if you read some of his transcripts, he even tells the lawyers who are questioning him, as soon as i'm finished here, i'm going to sue you too. >> wow. on that note of it being rare, how likely is it that trump's team will have to pay this fine? >> that's another thing. they may appeal it, but in all likelihood, when you are sanctioned, you have to pay the fine. for the most part, you may try to appeal it or move to reconsider, hey judge, moving to reconsider is always a dicey process, because a judge has ruled against, you and you are basically asking the judge, hey judge, i know that you have this take on the case, i want you to rethink it. it doesn't only go that we'll. so there's a good chance they may end up paying the sanctions. >> how about this lawsuit that we've already seen him drop now against laetitia james. do you think that other lawsuits could follow suit? >> yes. anytime you try to sue in attorney general to prevent them from suing you, normally, when you are sued, you defend it. you put in an answer, maybe you file a motion to dismiss, but you lineup your defenses and you fight the lawsuit. trump's approach is, you sue me, i will see right back. exactly. i will try to intimidate you. that might work with a corporation, because a lot of times, you can win a war of attrition. no matter what side is right. this is the seedy underbelly of litigation, is that a lot of time settlement is not about right and wrong, it is a business decision. the company says, hey look, we can keep paying these lawyers, let's put a new dollar value on this, everybody get out. when you're suing the attorney general, we don't care about stuff like that. for better or for worse, the government in their mind has infinite money. and so why not just fight it forever? and so suing the a.g., a really risky proposition. but suing companies to wear them down? that is something trump does rather well. >> on the regular, that was his playbook before all of this happened. >> absolutely. >> with james, not only the have to drop his lawsuit against her, but she actually filed a civil lawsuit against him, accusing trump and his family members of financial fraud. she referred them to federal prosecutors and the irs for criminal investigation. what is the status of that case? >> so separately, what a lot of people don't realize, the attorney general is a law enforcement agency but they also do a lot of consumer protection. so in a sense, the attorney general is acting as a plaintiff. not really as a arresting law enforcement agency. even though they do that to. so what laetitia james it is conduct essentially a civil investigation through her lawsuit, and then refer it to doj. and doj, by the way, has been getting a lot of referrals lately if you haven't noticed. january six committee, they are getting a lot of people telling them how to do their business. and if you ask merrick garland, he would probably get up on a podium and say once again, we make our own independent decisions, thank you for all of these referrals, we will look at them, but we are an independent branch. arguably in the cabinet, it is the position that is supposed to be the most independent, more independent and other cabinet members. so doj is an independent branch, you can make the referrals to them, you can handle them a flash drive with all your evidence, they will look at it on their own or make their own charging decisions or appoint a special counsel. >> special counsel, two words we have heard a lot of lately! and side note, nothing to do with this current interview, but also doj having to tell congressional committee members, also, we will not be giving you information on our investigations. >> very true. that is news coming out, absolutely. >> this is also interesting dannyhat a question you on so far, newly released transcripts show that trump confuse writer e. jean carroll with his ex-wife marlin polls when shown a photo during events this -- deposition. why is that important? >> first, interstate, not internationally but interstate extradition is really a foregone conclusion. whether you have a criminal justice background or you don't. the bottom line is article for the constitution pretty much mandates that if one states demanding someone from another state, they're gonna get that person. totally different situation if you're in russia for example which doesn't even have an extradition treaty with the u.s.. interstate extradition is a certainty. whether or not he's legally proficient, he probably got some good advice and that advice would be waive extradition. don't go through the hearing. just get back to idaho. >> so thus far with these details in the case, not a lot has been made public. especially in regard to the evidence police believe they have against him. this is because of that idaho state law that prevents its release of the affidavit to probable cause until the suspect appears in court in idaho. what more could we find out from those sealed documents once they are released? >> the affidavit of probable cause is just that. it's enough of the facts that law enforcement think they can make a probable cause without going too far. without revealing too much. this is a case where we don't know too much so that affidavit of probable cause is going to be critical we really don't know how exactly the police honed in on this defendant we know that dna was involved -- remember from the press conference to please wear a cagey about whether claude's had played a factor. i suspect we'll find out when we are now. they're nowadays, you have to ecological options. you can go to one of these 23andme sites. if you get a subpoena or if they cooperative. the case may be. you may not necessarily need to rely on quotas which is the national combined dna index system. that's a database that requires law enforcement to upload dna. nowadays, people are applauding their own dna just to find out if their european or south american. and you can get to someone's dna using the relatives. we live in a whole new era. you leave dna at a crime scene. odds are they're going to track you down. >> that was one of the biggest questions when things like 23andme came out is whether or not police or and have access to that the na database. speaking of not revealing too much from the police. friday's arrest comes seven weeks after the murder of those four college students. during that time, police released very few details about the investigation. for a few different reasons. not to tip off the suspect. to also not taint their case that a prosecution. can you expand on that last one? >> if you talk about publicity, that was a freeze alone forsman actually said at the press conference. what that means is this. ever since the case called -- shepard v. maxwell which was the inspiration in a sense for the rather old now movie the fugitive with harrison ford. that is a case that back then during a time when there were probably three maybe less channels on tv. the supreme court recognized that it's possible that pretrial publicity can deny a defendant their way to a fair trial. fast forward to modern times where we have infinite channels, infinite social media, it's hard to say what level of pre trial publicity might taint someone's right to a fair trial. under the constitution. the answer to that is been very few if any. and yet, yet you see law enforcement here being very careful. they don't want to create too much pretrial publicity to create a circus lay down a sphere that might lay the grounds for a constitutional attack. a claim of too much pre-trump oblivion by this defendant in the future. >> before i let you go. with the moscow chief of police call this a very complex case. can you expand on what added to that complexity? danny shaw. good morning to you, danny. and this is really significant, isn't it ? early significant, isn't it? early morning to walk us through the changes and what this will mean for victims as they're now deemed . okay. well, this is deemed. okay. well, this is a historic change. you're quite right to say that an amendment that the minister justice has that the ministerjustice has put forward to the victims bill, i expect that it will be passed by parliament and that most people would agree with it and it will mean that any child who is conceived through rape will be officially classed as a victim and will be entitled to receive the sorts of services that other victims of crime can get. so that could be support for emotional distress , could be for emotional distress, could be support for mental health problems that they're having . it problems that they're having. it could be support for depression, anxiety, post traumatic stress disorder , feelings that may disorder, feelings that may emerge later on in life as that individual gets older , a sense individual gets older, a sense that they don't belong . it's an that they don't belong. it's an incredibly difficult situation for people who have been conceived as a result of rape to begin . some people have managed begin. some people have managed to get on with their lives , not to get on with their lives, not an issue for others. their extremely traumatised and find it very difficult to fit in. so i think this is an amendment, i think that most people would support all of this seems to suggest that these children are then told what their heritage is in that sense. and which begs the question , do we think that. the question, do we think that. that's right . the question, do we think that. that's right. i mean, i know, as with adopted children, for example, it's encouraged that they are told that they are adopted and then obviously they have that process and it seems a much more difficult thing to tell a child that their father was a rapist . yeah. and this is was a rapist. yeah. and this is this is an individual thing. the state isn't saying what you should do or how you should go about it. it's saying the support is there automatically . support is there automatically. if you in this situation, it's estimated and this is an estimated and this is an estimate of this being produced by campaign groups that there could be as many as 3000 people a year in this situation, that sort of statistic is taken from estimates of the number of rape victims in the country and then the number of those who will fall pregnant as a result, the number of those who will fall pregnant as a result , those fall pregnant as a result, those minors, those who will have a termination . so that's a rough termination. so that's a rough estimate , which is an estimate, which is an extraordinary high number. and i think what you've got to remember is this isn't something that the government sort of just invented . it is come about invented. it is come about because of pressure from a woman who at 30 who was whose whose mother was raped at the age of 13 in the 1970s, she had to campaign for justice of the child as she got older for justice and she got justice in 2021 when the rapist , carvell 2021 when the rapist, carvell bennett, who was then 74, was jailed because . the child was jailed because. the child was there was then a woman provided dna evidence to sort of link him to the crime . and this is where to the crime. and this is where it's key. so it's not just about support, but it's also about the victim , look, i was born victim saying, look, i was born as a result of rape. i use my dna to try and find out who the rapist is. so there's a real link here in terms of evidence that could help prove a court case. and i think that's very important to remember. that's why it's called daisy's law, because it's after the woman daisy , whose mother was raped daisy, whose mother was raped when she was 13. but how does that work? i mean, that's impressive , but how does that impressive, but how does that work? i mean, because obviously that person is not going to be classed as a victim, although they're not going to get that support as a victim until there's been a conviction. will they ? no, i don't think that they? no, i don't think that that's how it works. i mean, i think how it will work is if there is the person's mother says she was raped and therefore her child is a victim because of that. i think you're right, stephen, though, to point out there is a question , how do you there is a question, how do you actually show to the authorities? that's the case . authorities? that's the case. and i think the question that will be asked is , will that lead will be asked is, will that lead to bogus claims ? will that lead to bogus claims? will that lead to bogus claims? will that lead to people coming forward who want support from the state or who want to take an action out against someone for malicious reasons, to claim that they were born through? right. and i think thatis born through?
