darrin wilson is a six year veteran with no disciplinary problems. they say wilson was investigate a strong armed robbery of a convenience store when he encountered brown. the chief suspect in that robbery. but some community members say they're not buying it. >> this kid was getting ready to go to school. why in the world what he want to go out and steal the day before he go to school? two days before he go to school. it don't add up. >> reporter: police also say brown stole cigars from the convenience store before being confronted by wilson who sustained injuries on the night of the shooting. missouri governor jay nixon urging calm as the investigation moves forward. >> there's a lot of steps between now and when justice is serve. and there are going to be lot of other bounces along the way. and they'll ab lot of tension at various times. >> reporter: now the focus turns back to safety. the state highway patrol firmly in command here in ferguson. they say the violence of the past week has largely subsided. law enforcement now reaching out to a trau

reporter: prosecutors expect it will take the grand jury until mid october to decide whether officer darrin wilson should be charged with killing michael brown. some protesters are calling for the removal of prosecutor bob mccullough because of his ties to police. his father was killed in the line of duty 50 years ago. >> the da needs to step down because he can't be unbiased. you know, he has cousins and family members on the police force. >> i think he's too close at the case. >> reporter: but mccullough says losing his father only made him more compassionate and he does not plan to step aside. >> i know the pain that the brown family is going through right now. >> we want to help as best we can. >> reporter: u.s. attorney general eric holder is in ferfer gus son meeting it were the community and getting a first hand look at the federal investigation into brown's death. the shooting has triggered more than a week of violence in the predominantly black suburb. last night some protesters through bottles and police used pepper spray. but it was more subdued than previous nights. in clayton missouri

they will decide whether officer darrin wilson used excessive force. charge should be. joining me now, defense attorney brian claypool. he has worked on cases regarding excessive force use by the police and kevin, and keith sullivan, also a defense attorney. brian, let me start with you. as we look forward to the beginning of this grand jury process what do you think is going to be foremost in their mind in what is presented to them? >> well, martha, first of all, over the past decade i have handled 10 shooting death cases, four involved unarmed men. two of those men were white. one was black, one hispanic. you made a great point earlier about police brutality is blind to race. with that said, this grand jury is going to want to hear information about how this shooting took place. remember there are two shootings. one outside of the patrol car and one in the street. i do have a real problem though with the fact that the grand jury process is starting so fast. my experience has been in these cases that it takes months. i had a case where it took a year
