we've got, from what i can see, 26% of the vote in, things are tightening between oz and dave mccormickbarnette a little bit further behind. where you see this? >> pretty good, spot on. it is about 2.5 points, last time we talked it was more like five, 4.5, five. the lead for mccormick continues to shrink ever so slightly. i will however caution viewers at home, we could be a ways away from this because there are a lot of votes outstanding up here in erie county, erie, p.a. i was looking at the numbers over the computer, 237 -- these are real votes for mccormick, 235 dr. mehmet oz, kathy barnette 224, so in this county alone, which is 15 of 67 in terms of size and pennsylvania, there is a lot of votes still out there. i look at pittsburgh, remember allegheny county, they are talking about two in population out of 67, and we got a ways to go there, too, talking 6800 rob votes, 40 to 100 dr. oz, and you see the difference here, grew up in washington county to the southwest. pittsburgh, the collar counties, suburbs, the excerpts, to the farmlands, energy is a big deal in that part of weste

kathy barnette who was in third overall received 143 new votes there, dave mccormick 147 votes and mehmet oz 133. so you look at this difference there and you say, hey, that's just 14 votes, but the last three batches of votes that have reported mccormick has closed the edge, closed the gap a little bit in this state. overall let me show you some of the areas that still have to report votes. you can see this is the places that have about 10% or more still to go. you can look at these counties, lancaster county where kathy barnette has the edge has about 87% reporting, still thousands of votes left to go if you're trying to figure out who might benefit from those votes, mccormick a little bit ahead of mehmet oz there, not much. so maybe those votes would help mccormick but there are counties where oz leads where there are votes still could be opportunitied. 91% in monroe county, here is a county where oz holds about a 10% margin there. if you pull out here and look overall, i want to show you how this lead has changed over the course of the night here. at 9:00 p.m. mccormick was in front,

tv doctor mehmet oz's lead is that linking, he is about 1,200 votes ahead of dave mccormick. thousands of ballots still need to be counted. kristen holmes is in pittsburgh with the very latest. good morning. >> reporter: good morning, erica. yeah, that margin remains razor thin. of course, the two big questions now are what is left to be counted and how exactly is that going to impact this race? so given cnn's estimate there are about 15,000 votes left to be counted, now, this is just a rough estimate here because not all counties actually give the exact amount of votes that need to be counted still, but of those 15,000 most of them are absentee ballots. now, this matters because what we have seen based on the trends of the votes that have been counted, absentee ballots tend to skew towards mccormick. this is something we saw yesterday. mccormick chip, chip, chipping away at that lead by oz and this is something that i have heard from the mccormick campaign now for two days, that is how they think they are going to win this election is through those absentee ballots. now, the

the answer to your question is that dave mccormick has outperformed dr. oz among the write-in ballots and the absentee ballots. and so his perspective, mccormick, is one of count anything that was not cast on election day because chances are, i'll fair better than will doctor oz. oz, you would not be surprised to hear, and with the support of rona mcdaniel from the rnc says, no, if they're lacking a date on the ballot, it shouldn't be cast. it shouldn't be counted. i should point this out. we are talking about ballots that came in by election day. so, this is not an issue of were they received on time. there's a state law requirement that says you've got to write down the date that you actually filled out your ballot. a federal court decision last friday from the third circuit in an unrelated case said even if you lack a date, it ought to be counted. so, mccormick is pointing to that decision and saying that ought to be the standard. >> so, essentially because of course the former president donald trump was really saying, look, declare that you're the vict
