and in the studio, david boies. he successfully argued against california pot same-sex marriage ban. set the stage. you saw the advocates make their case. tell me about it. adam: the room was absolutely packed. full of same-sex couples. gay-rights leaders. i think they left feeling pretty good but not as good as they might have. the questioning was more mixed than they might have liked. justice kennedy asked questions suggesting may be the court was moving too fast. maybe it should hesitate to change the definition of marriage, which he says we have had for millennia. in the second half of the argument, he made strong point of the dignity of gay families. the importance to children that their same-sex parents have all the benefits of marriage. on the whole, given how much more emphatic he made the second second of points, it is likely justice kennedy will continue down that path. the evidence was more mixed than i might have expected. charlie: is that disappointing to you, david? david: i don't think so. it would be

this one killing 2-year-old david just a little boy who was full of energy. investigators say that the mother his mother, 19-year-old josephine was carrying him ape cross the street when she was struck by the vehicle. the driver took off from the scene. they tell us the owners of that vehicle originally lent it to a relative a 19-year-old relative. they haven't released his identity. they came in from out oftown. he takes the car and drives around. he brings it back that night. they get in the car and leave and go back to williamsport. they have no idea the vehicle was in an accident. they come back yesterday and that's when they start hearing reports of an accident. the captain of the division picks up the story from there. >> they didn't notice any damage until the next day and they start putting one and one together and say this may be the car. that's when they started to cooperate with the police. >> reporter: that damage is said to be a broken left headlight that was broken at the scene. investigators still had a piece of that and when they brought the v

boy. stafford county sheriff's office saying they've arrested david john marcuson of fredericksburg the boy's foster father after this incident that happened back in january. we can show you a mug shot that we've been given by the sheriff's office here. we understand marcuson has been charged with felony murder and two counts of cruelty to children. the investigation discovered that the 12 -month-old baby had received several burns to his body to his face his neck, or the sew while mar marcuson was giving the child a bath. he was taken to the hospital in early january and died on february 1. since the investigation, mr. markinson was indicted and this happened on friday. kristin wright is working on this story and she'll have much more on news 4 this afternoon. >>> we have a quick look now at three developing stories. >>> starting in france where police arrested a 24-year-old computer science student whom they say planned to attack one or more french churches. investigators describe the student as islamic extreme frist algeria who already had been flagged by security officials as a risk. >>>
