today we're taking a look at "atlantic" with david graham. has written several stories about what happened in charleston south carolina, last week. and the first one i want to begin with is your look at the council of conservative citizens. and you label them and they have been labeled by other groups as white supremistacist group that inspired a racist manifesto. what is the council of conservative citizens? >> so it's -- by some estimates -- the largest such group in the country. it's descended from the '50s and '60s groups founded as a coalition of businessmen and other people to oppose integration efforts basically. these groups kind of died away after integration was legally mandated. in the '80s, it was founded by a former field organizer who felt that there needed to be some effort to basically oppose integration efforts. the manifesto says things like we oppose the dilution of the european race, forced integration. we think that european american heritage is important. they host politicians, they give money. and they campaign for thin

prosecutors said they linked matthew to the 2005 case using dna from the hannah graham investigation. news4's david culver is outside the courthouse in fairfax with more. david? >> reporter: the alleged victim told the court today that for anyone years, she kept the graphic details of this attack to herself, not even divulging it to her own family. in front of the courtroom, she said she fought and fought but her attacker overpowered her, brutally beating her and then sexually assaulting her with his happened. in opening statements, the prosecutor telling jurors the alleged victim was brutally beaten, punched and nearly strangled to death. she fought like the dick , he said, she fought like cracrazy. the attacker choked and choked until she lost consciousness. matthew has been charged in the 2005 incident. prosecutors say he attacked the woman in the city of fairfax, allegedly sexually assaulting her there, not far from a middle school and giant grocery store. he has been accused of trying to kill the woman as well. it wasn't until hannah graham's abduction and death in charlottesville did matthew

graham. northern virginia reporter, david culver, just got out of the courtroom and tells us why this judge says she is staying on the bench. >> reporter: in her ruling, judge cheryl higgins was adamant. she told the court that she can remain impartial and give jesse matthew a fair trial. this was very personal for her because her own daughter was brought into the defense's arguments. her daughter happened to be the same year student at uv a as hannah graham was, but the judge told the court that her daughter had no connection to happen nah graham, they didn't know each other but did concede her daughter may have attended a vigil while hannah was missing. i want to read a little bit what defense had to say. # >> commonwealth believe it is equally important for the community know it is being presided over by a judge within this community responsible to this community. and so for those reasons among others, the common beth felt it was important for the regular sitting albermarle circuit court judge who is judge higg , to be the judge in this case. >> reporter: matthew's defense worried about a con

the prime suspect in hannah graham's murder wilin tried for a separate crime a decade old. new at 6, davidulver will be in court for jesse matthew's trial. he's here now. what can we expect? >> a pretrial hearing is any indication, this could be an emotional, passionate trial. one filled with riveting testimony. arguments also between some of the counsel, prosecution april the defense. yesterday the judge gave permission for the woman who accused matthew of sexual assault to identify him in front of a jury. this was a big setback for the defense who keeps telling the judge they need more time to prepare for this case. but monday's trial date has been set for months. now, the alleged victim already flew in thursday from india. she was not there for the start of yesterday's hearing. prosecutors told the judge she was too tired to testify yesterday. but the judge ordered she be woken up from her nap in a hotel room and be brought to court. on the stand, the victim told the judge she was attacked while walking home from a grocery store in fairfax. that happened back in 2005. >> and that trial

graham murder. in fairfax i'm david culver, news4. >>> more than nine years after the d.c. fire and ems department agreed to make reforms, apparently there is still considerably more work to be done. a task force made 36 recommendations to improve things such as slow response times. a new d.c. auditor report released today found only 11 of those reforms have been fully implemented. the task force was created after a failed emsome response contributed to the death of a "new york times" reporter david rose.baum in northwest washington back in 2006. today rose.baum's brother told news4 he remains hopeful that reforms will be made. >> we could have the best department in the country in everybody pulled together and did that, of course, that hasn't been happening. today the d.c. acting fire chief issued a same. he -- a statement. he said he and the mayer are working to implement the task force recommendation. >>> now to the severe storms affecting so many of us. doug monitoring this all day from our storm center he is here now to tell us what is happening out there. doug? >> the

david? >> reporter: pat, this is a pivotal pretrial hearing in the hannah graham murder investigation and this capital murder case. behind me you will notice a lot of attention, several media figures standing outside the courtroom here in albermarle county. on the bench is judge cheryl higgin higgins, she denied the jesse matthew's team request to recuse herself there is a stipulation to this saying judge higgins signed off on 25 of some 54 search warrants executeded in this case against jesse matthew. those generated a lot of the evidence here. sometimes there are motions filed during these trials to suppress those warrants, essentially keep them from being used in court. the judge argued she felt she could rule on the warrants without any bias but has a compromise with the defense team, she called in another judge to rule on those specific motions, that is, she will call that other judge in when those motions come to the court's attention. she, however, will stay on this case. the defense also argues that the judge's daughter, who happens to be a student at the university of virginia would p

david: you know, danny, we recently had -- a couple minutes ago, we had a fox news reporter with senator lindsey graham't have the sound because it just happened. but lindsey graham said, look, we have to go beyond where we've gone with china. we have to tell them that our trade relations are at risk unless they stop this. china, without the us to trade with, their economy would shrivel up. >> well, there's a delicate balancing act there. the challenge that the us negotiators face, and these negotiations have been going on for years. it's one thing if the us is saying, don't spy on us companies. don't try and take their trade secrets. for the us to tell china, spying on government agencies is crossing a line. it's pretty thin ice there. the us acknowledges we do the exact same thing to chinese agencies. david: well, i don't know if we do it in order to collect spies the way the chinese are apparently lining themselves up to do. i don't think it's quite that bad on our part, do you? >> no. it's certainly not that bad on our part. we're not trying to infiltrate the entire country of china and learn any -
