david? >> hi, neil. this is five years in the making. we're learning today from the justice department, the u.s. attorney in delaware that the president's son, referred to by roberte will enter a pretrial diversion program, a felony gun firearm charge. a pretrial diversion program essentially is a program that would likely keep him out of jail and possibly offer him some type of probation options. doj says that he received in income more than $1.5 million in 2017 and 2018. he owed $100,000 in each of those years in federal income taxes. but those taxes were never paid by the deadline on the criminal gun charge, he did not plead guilty but he will instead enter that pretrial diversion agreement. here's his attorney this afternoon. >> do you have an idea of what the conditions will be? will he be on probation. >> it's up to the court. my expectation with regard to that proceeding he will be released without conditions. but you know, what the ultimate disposition of the case will be is up to the judge. >> we don't know who the judge is yet, neil. prosecutors say hunter biden had possession of a gun as a drug user. kevin mccarthy says the doj is keeping the investiga
