here. >> and you are with us, david sanford? >> yes. i am. >> and what is your reaction to the fact that it looks like kleiner perkins won except for the retaliation charge and it is looking like it is not clear cut case, but so far, it is not going in the way of ellen pao. >> and that is right unfortunately for miss pao, and she has lost on three of the claims. the jury has reach ed a verdict on three of the claims, and no discrimination and promotion or termination due to the gender, and no retaliation regarding the failure to promote, and jury apparently found that kleiner perkins took reasonable steps to prevent gender discrimination against her, but the jury has pumped, and not reached a verdict on the fourth claim which is retaliation regarding the termination after she filed the complaint, and did other things that were protected activi activity. >> and this is the wheelhouse, and you have done these cases before as a civil lawyer, and gender discrimination, and how difficult was this one for the jur jury? >> i think it i

issues before them to figure out exactly what that means and talk about this news, i am joined by david sanford as well as kenny benner in new york. david, let me start with you. tell me what happens. the jury came back and said what? you were in their. reporter: the jury held on three claims on behalf of kleiner perkins. they ruled against the plaintiff in this case it they said there was no gender discrimination there was a substantial motivating factor responsible for her failure to be promoted. for her termination, there was no retaliation against her with risk to promotion. are essentially did the right thing in trying to prevent gender discrimination. cory: so the firm was not responsible? reporter: right. they came back with a verdict that everyone assumed was for kleiner perkins on all four counts, but when the judge told the jury, it was eight four. you need to have nine jurors to get a verdict. they have eight against four. the jury has been asked to go back and deliberate on a final count. that count has to do with whether or not kleiner perkins retaliated against ms. pao is a result

mark sanford can go through that humiliation, still serve. david vitter can survive a scandal. t spitzer ran for office. he didn't win, but did run. is there a future for him? >> the difference -- mark sanford did approach a comeback with humility. i think he still does more town has per capita on average than most members of congress. he's very aware of what he cost people. he also had a constituency, because he was an aggressively conservative governor, who thought the obama administration -- schock never built a constituency apart from appearing on television or panels. there won't be much appetite for him to return, though the whole attention reminds me of michael kinsley say the scandal is not what's legal -- he will have ruined his career over stupid spending, stuff that no other member of congress could have done. but this was doorstepped and investigated by reporters, you know rightly -- i'm glad he was caught for this, but we're going back to a normalcy in washington with a replacement for schock, where far more money is being wasted on official projects. this guy was j
