joining me now is criminal defense attorney david schwartz to talk about this. nspiracy, four counts of illegal campaign contributions, and one count of making false statements. which would you say is the big one here, conspiracy? >> well, yeah, certainly the conspiracy because the conspiracy laws are so broad that you could find a person 1% guilty of a conspiracy and they're guilty of conspiracy. he has to take this seriously, the conspiracy, the campaign fraud, and the false statements. the false statements are the ones he may go down for actually. >> how hard do you think it's going to be as we look at what's on the table here for edwards' team to prove that the money was a gift, as they say, and no t the -- not a campaign contribution to cover up an affair and mistress. >> let me rework that premise for a second, randi. it's the prosecution's burden to prove guilt beyond a reasonable doubt. the defense team could sit on their hands during this team. if the prosecution can't prove their case, then he's not guilty. the bottom line is though i'm sure you're goin

our legal panel is here, lis wiehl and david schwartz. >> so were police corrupt? they were. they didn't have a lot of time to figure this out. they thought this nine-month-old baby and mother who apparently obviously ended up both dead were missing. >> gregg: why did it take them two days? >> by the thyme they got there, by the time they got there they were there and needed, they wanted to find that mother. they didn't go in. >> gregg: you are suspicious. >> we have a fourth amendment which protects us against illegal searches and seizures. it takes 20 minutes to get a warrant. >> you pick up the phone and call the judge and stated the circumstances and get a warrant. >> they had two days. they really didn't. they went missing in two days but they were adding up overtime. when they got to the door they wanted to get in and they had to get in. >> gregg: when you look at these cases. you got the circumstances but not in this case where someone is in the house. that is the case where this applies. >> mom and baby are dead inside. >> gregg: they admit they were not in

let's bring in our legal panel, david schwartz and kesha schwartz.he state of arizona is usurping federal authority because they are requiring among other things illegal aliens to carry registration papers to prove that they are here illegally. here is the thing. how it could be usurping federal law because that is already federal law? >> right. that is one of the points. we do have a clause that says that federal law is authoritative law. but the federal law requires that already. i think that what people are failing to realize this is more of an enforcement of that old law and not so much of an expansion. >> gregg: isn't arizona enforcing existing federal law but doing so at the state level? you know the u.s. supreme court courted has said in many matters there is concurrent authority? >> for sure the state can help enforce the federal laws that are already on the books. however, the state can't, they can't propose their own legislation. they can't enacted their own laws to preempt the federal law. >> gregg: what if the federal law conflicts with t
