david weiss. what's different about jack smith is unlike those two men and previous special counsels, jack smith was never confirmed by the senate as a u.s. attorney. will is a unique argument in that case that presumably, potentially the supreme court grab onto. what's so unusual is that judge aileen cannon is allowing outside attorneys not involved in this federal criminal case, so-called friends of the court, to argue on this issue in her courtroom. experts tell me that is unheard of in a federal criminal trial. it's just not done and it's one of the reasons this hearing is going to take a day and it's one of the reasons this case is taking so long to get to trial. >> there have been a lot of questions and some scrutiny into how she's handled this case. what more are we learning about these previous efforts, apparently, to get her off the case? >> reporter: yes, "the new york times" is reporting that two federal judges made an outreach to judge cannon when she was randomly assigned the case after donald trump was indicted asking her not to accept it, and the first judge according to "the new york

smith. fox news justice correspondent david spunt live in d.c. with more. longer this takes the supreme court to actually make a public decision, the further this pushes the former president's trial back. but as just about everything, there are caveats. the first is does this even go to trial? the former president charged with trying to overturn the 2020 election results, was supposed to go to trial beginning in early march of this year. that deadline are came and passed. the case itself has essentially been on ice since late december once an appeal was announced in the case. judge tonya chutkan, the federal judge in d.c. who's overseeing the case, has stopped all activity at least publicly on the docket until the supreme court issues results. the first appeal earlier this year was appealed before the d.c. circuit court. they ruled that donald trump does not have absolute immunity to avoid charges. but the supreme court decided to take over and weigh in on the very argument even though the d.c. circuit ruled unanimously that trump does not have full immunit

should say that this argument was made in the case of special counsel david weiss by hunter biden's attorneys. special counsel jack smith argues there's nothing improper about the way his offense is funded. there's a little bit of weird history here where special counsels today are funded under an old appropriation language from the old independent counsel statute that doesn't exist anymore, the independent counsel. that's part of the basis of the argument here. what the special counsel argues is that under the appropriations clause, this is perfectly normal and fine. there's a line in the law that says money is appropriated for independent counsel investigations by the justice department, and that's what's happening here. so once again, this is an example of a legalistic issue where trial judge cannon is having a half day of hearings on. whatever she rules here won't be the last worked. it's an issue for the appellate courts, a question of law, not fact. but she's asked both sides to brief each other extensively on it. >> and then this afternoon we have the gag order hearing. same question. what can we expect there? >>

the special counsels, whether it's jack smith, whether it's david weiss, who's got the hunter biden case's called subordinate officers. they're within the department of justice. they do report to the attorney general, and any day of the week, the attorney general could say, you know what, you're gone, i'm going to take control of this. it's just an internal regulation that is entirely constitutional. but the complete -- it's just shameless that it's like, you know what, it's a case that we don't want you to bring. we're going to say it's unconstitutional. if it's a case we do want you to bring, it's absolutely fine. and to me, that -- again, it goes to what you're hearing from donald trump, which is, if i'm -- you know, i'm acquitted, it's fair. if i'm convicted, it's rigged. and by contrast, you have joe biden truly living what it means to act out of principle. >> yeah, it is -- i mean, and to what tim's saying about -- there's people over here that you're never going to reach. there's people over here that are always going to support the president, that have read hunter's book or lived
