of serving with justice david souter. from my experience, there has not been a more incisive question than justice david souter. i remember when i was prepping one of the arguments, one of the things we really wanted to do was get the court to have a line of questioning about stripping eightieth corpus and whether it was -- we spent weeks trying to figure out, we bracing king about this line of questions. we didn't get just this stevens to do it. in the dna argument which i did in march there was a lot of questioning of is worried about getting, and sure enough, justice david souter was the one to lodge that folly of questions. his opinion on the dna case was a really moving opinion. event code to conservatism. it is about substantive due process and the need to go slow. that is not something we have traditionally seen a lot of in the supreme court for right and left of the court, justice david souter is staking that position in that case. it will be one of his great legacy for the court. >> i will miss justice david sout

she's probably just about where david souter is on the ideological spectrum in terms of being a liberaloo much of a change in terms of the voting. in fact, on some criminal law matters, she might be a little bit to the right of him. but you're right to talk about what goes on behind the scenes and in conferences, because another woman coming on to the bench would certainly add a new voice in that way. the ferris latina voice, the first hispanic ever in u.s. tree on the bench. i think she might offer a new experience to the justices. she also is one of the few justices in recent history who comes from a, you know, lower middle class background. we have to reach back to clarence thomas, to somebody who really experienced a near poverty in her youth. so i think she'll add a new experience to the court, but in terms of building a coalition, i think it will be too early to see, because as you know, andrea, these justices work over the long haul. they lay some seeds, that don't actually start to grow and really bloom until later in their tenure. >> justice thomas is notoriously quiet, silent

probably the best thing about being on the supreme court is the privilege of serving with justice david souterce, there has not been a more incisive questioner in so many ways than justice souter. i remember when i was prepping the hamdan argument, one of the things we really wanted to do was get the court to have a line of questioning about habeas stripping and whether or not it was violated. we spent weeks trying to figure out how can we bait justice stevens into asking this line of questions. didn't really get justice stevens to do it at the argument. but justice souter really got that argument. and i've never really seen him in such powerful terms attacking the government on this whole suspension line of questioning. a three- or four-minute colloquy with paul clement. on the other side in the d.n.a. argument which i did in march, there was a line of questioning i was really worried about getting. sure enough, justice souter was the one to launch that volley of questions. and his opinion in the d.n.a. case, i think, is a really moving opinion. it's a kind of ode to conservativism. it's wort

there was indeed a bit of the inner yankee, the flinty inner yankee to david souter in cases like that where the court is now no longer so clear. we haven't mentioned ritchie vs. sotomayor. ritchie vs. sew tai mayor. rich itchie vs. destefano. an interesting split, let me just say at the outset, i think this case has hardly anything to do with judge sotomayor's nomination. that having looked at it other the last couple of weeks, it seemed to me clear that second circuit precedent, for better or worse, was clear on this matter. and that the panel eas decision was determined by second circuit precedent and the reason the opinion is a short one is because it is controlled by precedent. the three judges on the sixth circuit saw this case exactly the same way not long after ritchie and decided it 3-0 in favor of not second-guessing the decision to set aside test results in an opinion the sixth circuit chose not to publish so that both the result and the fact of the shortness of the opinion, it's 100-page historic opinion because the court granted review in the case where the law, i thought,
