david: we saw fox early take a run at time warner and it did not work out.ll. you have a sense that fox, five years from now, it will not be what it is now -- it will get bigger, merging something else, or actually sell out? tuna: i think the company has taken great lengths to disavow the idea that they are looking to get significantly bigger. for theirr surprise intent financially to sell the entertainment asset, as you alluded to, was coming off of that bid for time warner. you have to balance with the strategic rationale is, and ultimately when you dig deeper, you get a sense it is all about monetizing effectively, the assets that you have. i think fox, argument, is well-position best in the news and sports arena, where disney -- there is a lot to be said about adding another layer of content to what they already have. in this landscape -- where everyone is rushing to get bigger, i think the relatively smaller players are going to get marginalized? that is how you can --marginalized. you can get an want to look at their portfolio and focus on their core c

david: at&t wants to buy time warner but the word now out of the justice department is a have some problems, on antitrust grounds, and they may sue. overnight, bloomberg is reporting that the lawyers of both companies say that if they are sued, they will seek discovery of everything that the white house had to say to you about the deal. journey us now is paul swinney, the director of north american research for bloomberg. so they are saying that we will -- and get the information about possible or possible white house interference in the antitrust review? paul: yes, i think this is another round of posturing on the part of at&t in response to what the department of justice has, and said on the marketplace that they would consider blocking the transaction. i do not think this is necessarily a route that at&t and time warner want to go down, but i recognize that their transaction is facing some of the more high-level scrutiny than they have ever expected or the market acted. david: softbank plans to invest as much as $25 billion in saudi arabia according to people familiar with the matter dee

and warner brothers without violating antitrust laws as possible attorney david balto joins me to discuss this a lot of people are looking at this going i don't know how to squint your eyes tilt your head eighty five billion dollars merger is it actually violation antitrust laws in your perspective well that's for the department of justice and perhaps a court to determine there are some kinds of concerns that might arise but they're not the traditional concerns they give people really upset or two people are direct competitors in the time warner aren't direct competitors so will it violate the trust laws there may be concerns those are typically taken care of by some kind of settlement between the department of justice and t.n.t. right so this is a vertical merger and it seems like the d.o.j. would be obviously preparing paperwork for any sort of eventuality when when this league was told to the media everyone freaked out oh there it's going to be blocked but in these types of mergers traditionally they're not blocked they go forward all the time you know lindsay the last time the justice

david >> thanks, carl. yeah, maybe we'll get to more time warner/at&t talk, but did want to also talk a little disney and fox not from me, but from john malone, who i spoke to earlier this issue of scale has come up so often in the conversations that we've had so far today, namely the lack for some companies of it and, of course, the dominance of facebook, google, amazon, and to a certain extent netflix, as well. all of which led fox, certainly, to entertain the potential sale of its entertainment assets to disney i asked malone, who knows rupert murdoch and fox well, what he thinks about that proposed transaction. >> stale two things, i think. one is that disney, of all the guys in the studio business, disney is the most unique in the sense that it owns its ip on its most important entertainment products so if you think that the whole -- that whole structure is going to be under stress, why wouldn't the murdochs want to put their stuff in and ride along in something that they've helped make bigger scale and that has this protective element of intellectual property ownership, right between marvel, star wars.
