david m. rubenstein national center for white house history. in 1901 when president william mckinley was assassinated, vice president theodore roosevelt became the youngest person to hold the office ever at that time. he was just shy of 43 years old. early on in his presidency, roosevelt asserted his personality on the office. he wanted to expand executive power and he did this, actually, with the building of the west wing in 1902. part of the reason this happened was because the roosevelts moved into the white house with six children. and all presidents had worked on the second floor of the white house. the work spaces were on the east end and the family's private quarters were on the west end. because the presidency has expanded, there wasn't enough space for roosevelt's family and the people who were supposed to be working for him. so he hired an architectural firm from new york which not only oversaw a major renovation project within the white house to unify and return it to its roots, but also to build the modern presidential work space. today we call this the west wing

david spunt in d.c. thanks a lot. bring in former u.s. district for the southern district of new york andrew mccarthy and ted williams. gentlemen, welcome. >> thanks, mike. >> mike: andy, 23 of 27 charges convicting these three men that's a whole lot of charges for a jury that doesn't do this for a living. how do the prosecutors stack those charges, arrange them in order to get those serious results? it's interesting, the last thing that the prosecutor said, and i think this turns out to have been a brilliant strategy on her part, was that the jury should work from the bottom. that is at the bottom of the indictment you had the felonies that were the predicates for the felony murder charges. there were four of those. so there were four underlying felonies. there were two aggravated assaults and two false imprisonment charges. from there you work -- if you convict on those, it's very seizey to convict on the felony murder. and then by the time you get to the big count, which was the malice murder, that they convicted the actual shooter, on travis mcmichael, number one, you already have convicted people of murder. and y

william bryant, are also on trial. no indication whether they will take the stand, as the defense continues its case legal analysis now david henderson, civil rights attorney and cnbc contributor, who is currently having a musical interlude. did mcmichael help himself on the stand today? >> you know, shep, he did. this is a case where is it always dangerous to put your client on the stand? absolutely but in this situation, you have to you have to understand, he's not saying i didn't do it. he was saying i was justified in doing it so you have to offer some evidence to support that justification. not saying i agree, just say thing has to be some evidence. and with these facts, i don't know what you would have without his testimony. >> if you were representing these defendants, would you recommend the other two also take the stand >> you know, that's very difficult to say i'm going to have to see how the evidence develops to make that determination. generally, that's what goes into these types of decisions you want to see how well he holds up on cross-examination. if the prosecutor scores a bunch of points, it's very risky pu

williams. now to another story that we're following. jury selection starting in the trial of actor jesse smollett. he accused of lying to police about being attacked in 2019. davidt was silent this morning as he walked in. a jury will decide if he's a victim of a perpetrator of a scam that prosecutors say he hope would raise his public pro fault. he said he was assaulted by two men that shouted racist slurs and yelled "this is maga country" in reference to president trump. he said the attackers placed a noose around his neck. two weeks later, his story crumbled. two men that worked as extras on his tv show told police that they were paid $3,500 by the actor to stage the assault. he denied it was a hoax. >> i'm an advocate. i respect too much the people that i'm now one of those people that have been attacked in any way. you do such a disservice when you lie about things like this. >> additional criminal charges against smollett were dropped after he agreed to perform public service and agreed to $10,000 bond. but following public outrage, a special appointed. the judge today was asking perspective juries very specific questions. he wanted to know if they watched
