a daycare has been shut down. and kent doe says you won't believe where social services found a baby. kit. >> reporter: this is not a run down building. this is an immaculate manicured house. the owner has been licensed to have a facility for the past 18 years but tonight stephanie's daycare has been shut down indefinitely. when the california department of social services arrived at the house for a surprise inspection they waited no time. an investigator told the owner they got a tip a child was being mistreated the investigator went upstairs to find an infant inside a closet strapped to a car seat facing the wall in the dark. neighbors are shaking their heads. >> in a closet like that. the kid's got to be pretty scared. almost to the point of abuse i think. >> the investigator unbuckled the boy and took him downstairs. legal documents say he had been restrained like that several types before. they're also investigating unspecified allegations. neighbors say she lives at the house but there was no answer. she has

this is a daycare center, a daycare center where we spent some time, our first day. also showed me the restroom, the bathroom, where 16, 17 kids and their teachers huddled and prayed and miraculously they came out just fine, but all of the walls around them, the roof, gone, as you can see there. had they not been in that bathroom, are the death toll in oklahoma would have been higher. and this is what a lot of folks have been talking about over the past few days local municipalities, local municipalities there should require homeowners, should require business owners, should require schools to have safe rooms. >> it's hard to believe given where they are and what they experienced before in moore that everyone isn't required to have some sort of a cellar. the power of this ef-5, it didn't necessarily keep the doors on some of those cellars. there were people inside, whoopt, they would fly off. with regard to that daycare center, i want to go back to that. we were listening yesterday to a 911 call from a daycare center. and the terror people experienced trying to prote

they shut down the daycare in milpitas last month. the owner now has 15 days to appeal the decision. in documents obtained by nbc bay area, they wrote that the daycare worker didn't conduct background checks on the workers. nobody answered the door when we went to the home this morning, nor did the owner return our phone messages. >>> a follow-up tonight on the bad bolts, now, they're testing a different set of bolts. after deciding to fix a different batch of bolts that failed this year, caltrans is testing a different batch of bolts. smashing them trying to see if they can hold up under pressure and if they need to be replaced. caltrans says the latest batch of bolts is performing as expected. but it will take a few more weeks to perform the tests. it is going to cost more than 10 million to conclude the testing. if the bolts are the only one that needs to be fixed caltrans says it could still make that labor day opening. >>> in education headlines, the state assembly passed a bill that requires california schools to let the transge
