we have dbi okay and we have taken the steps to be compliant and we are waiting on this appeal to get our final permit. the only thing holding up is this. we have two other locations, one on valencia street street and one in hayes valley. both of those are commercial spaces under residential apartments and never once in that time have we had a complaint from above. i'm not sure if you have had a chance to look at or not our petitions but we passed around them to the fellow neighbors that we share the building with and we got signatures from nine people above us that it's not too loud. that we are helping the community and they like the improvements made. once before we moved in it was a run down location and as one of the tenants of the building upstairs will attest to and it's in the letter that the blockbuster was noisier noise than the gym and people would be under where the gym is now at 1:00 o'clock in the morning. our gym is only open until 11. furthermore the location was abandoned after the blockbuster moved and before that was essentially a homeless shelter. there was human f

my name is kanty and i am the project direct for dbi, we are getting really close to the user acceptance testing and execution, relative to november the 5th and that is the plan. and the execution would be over a period of four weeks, and that is the wrong two, and then we are going to do the majority of the back office testing during. and our subject matter experts and their staff who do this every day and that they are going to be helping us with this testing. and we are planning to send out communication to the stake holders who are going to be helping us with the review and the testing of the citizen for the permitting and also, the communication, and that the actual review of the citizen portal is going to be in december. and so we are going to try to send the communication sometimes in the next couple of weeks so that they can plan for their time. the same thing will go for the citizen advisory group, and it would help us review the on-line permits and enforcement records on-line. that is all that i have, and just an update, is there any questions? >> >> is it march? is the new dat

i guess it is my job to point out the dark side of dbi. the code enforcement process, listening to this and i thought that i should point something out is that one historic flaw in the enforcement process which hopefully has been corrected, is the easy subor nation of these orders and someone comes in and whoever is in charge of issuing it, will say, they have issued or taken out a permit into is your subordination and there is no longer a loan problem, we can finance on the property because we subordinated. that is a serious flaw in the system. and i don't know if it has been corrected by now or not. back to item b on this proposed legislation or the health department is trying to get us to enforce noise issues, emissions issues, and there is a history in the department of the health department trying to force us to do things. clearly noise issues are in their jurisdiction, and also, emissions and pollution is not in the building department purview it will be the building or the health department and i think that we should put our foot do
