nbc 10's deanna duran at thiste was in the courtroom this morning. what can you tell us? >> reporter: this is obviously a very unusual case one where the attorneys were citing case law and records from the supreme court ruling saying that the original grand jury case can proceed against kathleen kane. here is what happened today. she was supposed to be here to answer to a three-judge panel why she shouldn't face contempt charges. however, her attorneys argued that that whole plan should be thrown out, that she shouldn't have to answer to them because the judge should recuse himself and because this office firing was restructuring and was no way in retaliation against a man who had testified against her in a grand jury proceeding. >> -- because it does look retaliatory. why not wait? >> it doesn't look retaliatory at all because as you would see at any proceeding this steps were taken to reorganize the office to make it more effective, to make it more efficacious, to streamline the process, to make it more responsive to the needs of the office, and there's no reason to awa
