deanna has been watching passengers connecting with their loved ones. more people showed up in the last 30 minutes, right? >> reporter: yeah, a number of people have. we're being told buses are starting to leave from area hospitals where people have been treated and released. amtrak workers are trying to assist them to get back to where they need to be. also here all night long people who have been stranded, people coming from south carolina people want to go to new york, to boston and were getting off their trains here. we talked to people on trains from d.c. from baltimore, that they were already on board the train when they heard about the derailment that happened in port richmond. they didn't have any choice but to get off the train here in philadelphia and wait to go back where they came from. >> there's no way to go any further. we've been here since probably around 11:30 waiting to figure out if we can go back. there's no means for a bus really until possibly 2:00 in the morning and there's no lodging being provided and there's no food voucher. t

"nbc 10's" deanna durante is live at 30th street station. passengers are still trying to figure out how to get back home right? >> reporter: they are. the american red cross is assisting a number of them at this point here down near the market street side of the train station which has been blocked off from the general public. we're told that they've assisted about two dozen people so far this morning and that they are trying to get them transportation back to where they need to be. we have watched not huge crowds of people coming here but one or two coming in with amtrak personnel come to go 30th street station. it's been a very frustrating night not just for passengers aboard the train but other passengers who have been stranded here at 30th street all night long. some of them not even fwheeg had happened until they either got to wilmington delaware or here in philadelphia and found out they wouldn't be going anywhere for quite some time. >> no choice to get off. there's no way to go any further. we've been here since probably around 11:30

deanna durante is live to ex- explain. what did we learn? >> reporter: the ntsb says ail note cell phone was used last tuesday, it still has a lot more work to do to determine if the phone was used at the time of the derailment. the ntsb says it has the cell phone of brandon bostian and record shows calls were made and texts were sent and data was used but it says now it must look at the times the phone was used and match the times with information from the train's data recorder. and train cameras to determine if the phone was used while the train was being operated. the ntsb says there were no issues with the rail signal system. and the ntsb confirms what nbc 10 news told you yesterday that bostian was heard on the radio, talking about a stopped septa train minutes before the crash. investigators are finishing up documenting of the train equipment and railcar damage and are still talking to those who were aboard the train. philadelphia's police commissioner says his detectives remain working as a support role to the ntsb and says at this po

deanna durante, nbc 10 news. >>> and the first funeral was held today. u.s. naval academy midshipman justin zemser was laid to rest. members of the academy gathered with friend and family on long island to say good-bye. he was traveling from annapolis to his home in new york when he was killed tuesday. he was a member of the navy sprint football team, the jewish midshipmen club and the semper fi society. today his fellow midshipmen at the academy lowered the flag to honor him. his funeral included full military honors. his commander officer called him a phenomenal young man. his fellow cadets agreed. >> very humble very passionate young man. it's really all i can say about him. he was great. nothing is overinflated that you hear about him. >> there will be a private memorial service at the academy on sunday. >> zemser was one of eight people who died in the derailment. the eighth was a man from italy who was in the united states on business. some of the injured are still in the hospital. temple is treating nine victims, five in critical condition. five patien

nbc 10's deanna durante has been reviewing a report just released by investigators. >> reporter: thetsb says the engineer of that amtrak train had used his cell phone, made calls, sent text messages the day the train derailed. however, they say, they are still working to confirm whether or not he was using that phone at the time he was operating the train. also today, the police commissioner of philadelphia says at this point, his detectives have not sent anything to him that shows him there was any criminal activity involved. >> right now i'm not aware of anything that is going to result in criminal charges, but it is possible. i mean a d.a. can review this. there could be something i'm not aware of. that would lead to that. >> reporter: philadelphia's police commissioner says he has not yet been notified of blood or toxicology results of brandon bostian. he confirms the department got a subpoena for the blood and cell phone records. it has possession of the cell phone and records show calls were made texts were sent and dat qua wasa was used but the ntsb cannot say if the phone was
