nbc 10's deanna durante is live along the route on the ben franklin parkway. >> good morning, rosemary. we've moved to the finish line. we were coming to you earlier from the starting line. take a look as they're getting ready here. the marathon into its second hour. we can tell you that the first wheelchair athlete crossed the finish line in less than two hours. despite this chilly start to the day. and it was a little colder than yesterday. yesterday the half marathon people had 60-plus degree weather to run in. today it was a little chilly as they took to the starting line at around 7:00 this morning with the 20,000 runners taking part in this two-day event. and some of them say they trained all year for it so it doesn't matter what the weather is today, they were showing up. we have talked to runners from virginia, rhode island, even tucson, arizona. that are happy to run here in philadelphia, no matter the weather. >> it was a little chilly. the wind, but we'll be all right. we're hoping to huddle in the pack and try to draft a little bit. >> now again we've got an update just a l

deanna durante just spoke with some district attorneys who crafted this plan. she's live in chester county with more on what it means for people across pennsylvania. >> reporter: the district attorney here main chester coun say that they will have information from the start. he also says one of the most important things is that when a police-involved shooting occurs, an outside agency will handle the investigation. >> when it's a close call or a controversial call, then there would be criticism if an agency investigated itself. so by having an independent agency do the investigation, your remove that criticism about bias in the investigation entirely. >> reporter: if necessary, outside investigators or state police could handle it depending on its needs. the victim of the police involved shooting gets medical attention right away. >> the person who has been shot, the police should try the save that person, they should perform cpr on this person. it sends a strong message to the li public that the police do not want to kill that person. >> reporter: the justice

next 10's deanna durante was live in norris town. >> reporter: bill cosby is a known celebrity worlde. defense lawyers say that many other victims came forward within the past two years in part because of his celebrity and they want to keep the testimony of other women who say they're victims out of court. prosecutors say the 13 women they want to bring to testify against bill cosby want to show a pattern, that he became friendly with their families and placed them in situations that he could control. the defense says the accounts of those 13 women are not specific and they can't remember dates times or places where the alleged assault took place. the alleged crime in question here, the 2014 sexual assault inside cosby's home was not prosecuted 11 years ago when that complaint was first made. >> mr. cosby's rights have been violated in many other ways. these -- fair and just and to the point. >> reporter: and the deef says there's also this. >> bruce castor, a former da who refused to prosecute bill cosby. >> the defense says steele vilified cosby and made a campaign promise to voter

nbc 10's deanna durante was the only reporter who spoke with the victim in this case. she joins us live from the bensalem police department with more, deanna. >> reporter: that woman has agreed to speak to us because she wanted other people to take a good look at this video, as well as police, they want you to look at it too. maybe you'll recognize him and turn him in. >> my first memory is, i was awake and there was a man in my living room. >> reporter: police say this is that man. look closely. police say you can see him breathing hard. residents say video captured by the apartment complex cameras shows him running from the family's apartment. the bensalem mother fought him and successfully got him out of the house. >> my daughter waking up was the key that scared him enough to give me the opportunity to get him out of the house. it happened so fast. >> reporter: it was 5:00 a.m. saturday morning. police say this guy broke in through a window and right away targeted the sleeping woman. >> this woman is incredibly brave, she was able to fight him off, probably a mother

deanna durante is looking into the voting irregularities. >> i was looking forward to voting. it's been a long election season. >> reporter: as the poll was closing, we met mike. he had been there earlier in the day to vote. he doesn't want his last name used, but he does want answers about his ballot. >> i told them my name, and they said, oops, you already voted, and i said i did not vote. >> reporter: but he hadn't. when he brought it to the judge's attention inside the polling location, they looked at mike's signature and the one by his name. >> they clearly could see it was not me who voted. >> reporter: but who was if it? >> it would be great to find out who stole my identity and cast my vote for tonight. >> reporter: we can tell you that the township police are investigating. a spokesman for montgomery county said it is aware of it and of the police investigation trying to figure out if this was a crime or a mistake. we are also at gop party here in montgomery county where the mood is turning cautiously optimistic are after they're watching the returns in the presidenti
