deborah feyerick live in boston with more for us this morning good morning, deborah. >> reporter: good, carol. the judge right now is giving instructions to both sides and to the jury as well. the opening statement by prosecution has not yet begun but what jumped out to me was the demeanor of dzhokhar tsarnaev. he was flanked by both of his female lawyers. he looked comfortable. he was smiling. he was chatting. this is the first time he's been back in this court since he was found guilty of those 30 counts including using a weapon of mass destruction to kill people. he looked comfortable and relaxed. the jury is going to have a very interesting time during deliberations deciding which is the worst penalty, whether it's death or life in prison. watching his human interaction between tsarnaev and his two lawyers, it became very apparent that he's going to lose all human interaction if he is sentenced to life in prison. i spoke to a close friend of his who said you know the tsarnaev she knew was a lifeguard, was reliable was friendly. always the one you would go to if you needed to talk a

let's bring in deborah feyerick and i'm joined by hln legal analyst and criminal defense attorney joeyn. welcome to both of you. welcome back joey. deborah, we know what those questions were. >> there were two notes. the jury is paying close attention to the language and precise language being used. they had a question to conspiracy and to aiding and abetting. they wanted to know whether conspiracy was a single event or it would take place over a continuing amount of time. the judge said it's not limited. it's over time. they also had a question about aiding and abedtting and whether that was two separate ideas or one. the judge said it was one. so when you think about what they asked about, conspiracy it applies to count one, using weapons of mass destruction and using a bomb to destroy a public place and destroying public property. two are death penalty eligible. when you look at the verdict sheet, the verdict sheet has the counts that are listed and then they have to vote on subcategories and they wanted to know if they find him guilty of a particular charge do they then have to go
