won't we also, in the very way the defense attorneys do their cross examination, won't we know what defensehey're going to use? i don't think they'll go after an insanity defense at this time. >> there's no real mystery about where this case is headed. this is not a whodunit. the case will turn on the mental health issues. we talked about insanity, a total defense where a defendant doesn't understand and appreciate the wrongfulness of their conduct, they can't be held criminally liable. with diminished capacity, it's slightly different. it's that there's still mental health issues going on, but you can be held criminally liable just for a lesser crime. so it can turn a murder into a manslaughter. >> a lot of people don't understand that, though. you have insanity, which i think some people assume right away, well, if you have some kind of mental illness, you might actually qualify for an insanity defense. you can be mental ly ill and no insane. make no mistake. what about diminished capacity, what do you have to prove -- does it help you that much? >> it's all a matter of degree. for the in

defense. we have codified it in policy over the years and certainly things have advanced since 9/11 and hurricane katrina, but there has been a real gap in detailed preplanning for emergency response, particularly as it works its way down the chain into the tactical forces that would respond, most specifically i think those on active duty. this is an area that we don't tend to pay a lot of attention to and very often when it comes we tray to look the other way. i believe that we have been reasonably responsive in immediate response, immediate response by doctrine and policy are military dod authorities moving out their gates into their neighborhoods when a disaster hits right next door. i mean, that seems to make sense. we have good relationships at our bases and stations and the ability to roll out and assist is something you would expect to work out pretty well. some of that has matured, in fact. in the state of california we have established a number of agreements, most particularly the wil

if you are going to claim self-defense people that are victims in a self-defense situation don't bring the weapons with them. they don't clean up the scene. they don't destroy evidence and they don't take the murders with them. forget the two stories and her personal history. all you have to do is focus on a bloody fingerprint with two sets of dna on it the victim's and this suspect the defendant. that is all you have to do and you have her in pictures. she took the weapons. so where are the weapons. >> judge jeanine: what mark is talking about is there is a camera and apparently the camera -- she takes pictures of him when they are having sex and the camera falls and it shows pictures of her dragging his body across the floor. >> not of her. >> good defense attorney. and she puts the camera if the washing machine a whack job. >> and eraise the pictures prior. there are many problems here. and friends that will say that she was engaged in stalking behavior prior to this. going see him. she was coming to live closer to him. she was -- >> a coworker of his. >> which is why in reality thi

i'm for a robust defense. i'm called a defense hawk. on the other hand, there's a big tail in the defense department and a smooth tooth in the tail including the way health care is delivered there needs a second look. >> brad, you're very close to these house republicans. we heard paul ryan sunday on "meet the press." sequester, everybody is against it. everybody says they're against it from the president to paul ryan. and yet it's going to happen. >> there's an emerging view among house republicans there's only one place the president is willing to cut the budget and that's here. perhaps he likes this even less than republicans like it. not just because of the defense department. plenty of republicans have lots of misgivings about it. we think it's bad policy. i think we'll see the questioning go to israel and iran and, you know, conservatives have long viewed this pentagon as a check and balance on the president somewhat. they're comfortable with leon panetta, comfortable with gates. the fact hagel is not as close to most republicans

to cut into defense reform. what are some of the other things you'd like to see to get more for each dollar spent on defense? >> we have to look at it across the board. we've had some sort of acquisition reform pass congress i think roughly every other year since i've been here and now most acknowledge it's worse than it's ever been. one for example proposes that we get rid of all regulation in the department of defense internal and external unless there's a specific decision by the secretary to put it back in. we're going to have to get more drastic than we thought of before. personnel reform needs to be a part of it but i think especially for the younger people coming into the service, an automatic 20 year retirement, health care and so forth like we've had before, may not be part and -- part of the package moving ahead. and it may be in their best interests to have some greater flexibility on those personnel reforms. of course we're waiting on the commission now that is going to make some -- >> you think ther

let's move to the defense secretary as well. what can you tell us about the president's pick for defense secretary, the controversy down in d.c. surrounding potentially that choice? >> reporter: what has concerned both republicans and democrats, in terms of the choice of chuck hagel for defense secretary is essentially remarks that he made when he was in the senate about israel. in 2006 he gave an interview tomorrow toer middle east envoy aaron david miller. hagel said the following. >> the jewish lobby intimidates a lot of people up there. i'm a united states senator. i'm a united states senator. >> reporter: hagel favors direct talks with iran and as well as hamas. and he was one of two senators to vote against sanctioning iran. >> he consistently advocated weakness with respect to our enemies, with respect to the nation of iran. he has opposed sanctions over and over again and the job of the secretary of defense is to be a serious, credible strength and deterrent and, unfortunately i think weakness in a secretary of defense i

as secretary of defense i also benefited from his work when he served on our defense policy board. chuck hagel is a patriot, he is a decorated combat veteran, and he is a dedicated public servant. i believe his experience, his judgment, his deep understanding of the security issues facing this country make him the right choice to be secretary of defense. as for me after close to 50 years of serving the american people began in 1964 when i served as a first lieutenant in the united states army and then in both the legislative and executive branch positions in washington. the time has come for me to return to my wife sylvia, our three sons, their families, our six grandchildren, and my walnut farm. dealing with a different set of nuts. [ laughter ] i want to deeply thank my family for giving me the fullest measure of love and support during my many absences from home throughout my long career in public service, but i will leave washington with a very deep sense of pride in what we have accomplished during these last four years being on the president's national security team. as both

are we really better off when we say no defense is a good defense? >> chris: i want to put up an ad that gun control advocates have started running against new democratic senator heidi hei dcamp of north dakota when she said some of the president's ideas about gun control are extreme. will that work. can ms. tanden and their allies and they have suggested they can drive a wedge between people like you, the heads of the nra and some of their members who may not be as hardline as you guys are on gun controls? >> i think the senator from north dakota is reflecting the views of the people that sent her to washington. so i don't think there is much room to drive any wedge. i think she is representing them rather faithfully and i think it is noteworthy that a democrat who would be under a lot of pressure within their are caucus to take a gun control point of view is not having anything other. >> that s not true. heidi heidcamp has heard from both sides of the issue and now said she is open to discussion of the issues. i think the challenge here for the lea

pentagon not questioning past secretaries of defense. i can only speak for myself. who understands the realities of consequences of war. it doesn't mean i'm better. but that is who i am. i don't walk away from that. i acknowledge that. i don't see the lens of every world event and whether we should use american power through the lens of vietnam but it is part of me. it is part of that lens. i think that's for the better. i think we need to be cautious with our power. i think we need to be wise with our power. we have great power. we have awesome power. no nation in the world is even in our league. we have done so much good with that power. i don't think there's a nation in the history of man who has ever been as judicious and careful with his power as we have. i want to continue to do that as you all do. we'll have differences, senator, on policies. but all i can do is my best based on my own experiences and, as i also said in my statement reaching out, listening, learning, never knowing enough, understand circumstances change. >> senato
