my name is deion kohler, and i'm a professor of law and director for center of sport and the law at the university of baltimore. i'm also a former athlete and proud parent of an ncaa division iii athlete. thank you for inviting me to speak with you about these important issues. for decades, congress has referred to the ncaa to build a model for intercollegiate sports that has grown into a multibillion-dollar industry. the ncaa calls this the american model. courts are increasingly vile -- increasingly calling it a violation of antitrust law. the ncaa supports to seek legislation so it can preserve what it defines as amateurism. in reality, it seeks to preserve the cartel profits that an unnecessarily restrictive amateurism model yields. the action sought by the ncaa would not only cause further harm to athletes but ultimately to the entire college sports enterprise. it is a model that is literally breaking under the weight of its own injustice. the decades of excess have been abuses perpetrated under the guise of amateurism are well-known and at times have been the subject of reports in
