cnn's deirdre bosa here now. what's the beef here, deirdre?ing up. the union organizers will appeal the election and if they are successful, it could lead the labor board to toss out the election results we got today and set off the process all over again. the organizers can also pursue legal challenges in courts that can drag on for weeks, even months meantime, the battle continues to draw national attention this afternoon, senator bernie sanders weighing in on the results, saying that he's disappointed, but not surprised. he says workers should be intimidated or badgered by a company and suggested legal anti-union behavior. for now, today's outcome was certainly a defeat for union organizers and the labor mu movement this could have set off an effect of other organizing drives across the country. so a little cold water there but in the longer term, it could be just the beginning of warehouse workers in amazon, which is now the second largest private employer in the nation and keep in mind that overseas, amazon's labor battles are heating up

. >> ibm set to report earnings after the bell deirdre bosa has a preview of those numbers for us >>us will be on big blue's spin-off of its information services business that was recently named kyndryl. the street is eager to see if they can return to revenue growth, which would be encouraging. keep in mind that ibm has seen its revenue decline on an annualized basis in eight of the last nine years. shares are up 6% this year making it the underperformer among legacy tech names that have seen value investors drive the wider group higher back to you guys. >> thanks so much for that up 6% or so this year, mike, but last quarter wasn't particularly encouraging. they haven't had many encouraging quarters for some time but last quarter was a big gut check. >> if you look longer term it's really been very range bound in a market where you piled up a lot of gains many concentrated in tech. it's been the same old type story for ibm in terms of slow top line there is a chance this spin-off does liberate some value i've always said that in theory there was something very similar to accenture

deirdre bosa just spoke to ceo ruth porat deirdre?th her, sara as he mentioned that the additional $50 billion buyback was part of a continuation of their existing program she said the primary use of capital is still to support long term growth. they're going to be investing it back into the business the pace of buybacks has increased over the last few years. on cloud i asked her if this would be another investment year, if they would start looking towards profitability. she says there's still a sizable opportunity so their approach hasn't changed some interesting comments on privacy. we haven't heard her comment on this on previous calls she says privacy is absolutely core to what we do, no question the privacy landscape is changing and regulation is rapidly evolving like regulators, she says they want to protect users. i asked her if they would be limiting third party cookies on android, youtube, search she said "not much more to add." that feeds into the idea, some critics say these are for show only and what are they really doing
