his lawyer and that delaware case file for motions to dismiss those federal gun charges. i think the strongest one is a case that the actual underlying law preventing people who abuse drugs from owning a gun is unconstitutional. it violated hunter biden second amendment rights and because of the supreme court decision in this landmark gun case which was in new york, the law should be struck down. there could very well be a case for that but you didn't see hunter biden's lawyer arguing he wasn't using drugs or that he didn't have the gun because in that sense, prosecutors have him dead to rights of the need to argue the law itself is unfair. host: let's talk about president biden's brother james who has also been subpoenaed. how does he fit in to this investigation on the tax side or the impeachment? guest: that's one of the strongest arguments that hunter biden's business entanglements go beyond him as a private independent. james biden was deeply involved in these deals, particular one of the most lucrative once in china. james biden and hunter biden come from different

>> short, we will see something similar to what we are waiting to see in delaware. first we are waiting to see the unsealing of the court documents, we are waiting to see the nature of the charges. and we expect to hear his -- have an arraignment, likely next week probably, that would be the expected timing. and then, i would expect that his lawyers will try to fight these charges the same way they are fighting the charges in delaware. it's been interesting, anderson. over the last several months, we've seen a much more aggressive hunter biden. he, along with his attorney kevin morris, they brought on abbe lowell, of course a very prominent attorney, to take a much more forward leaning approach to his detractors. now, they expect that the criminal case was gonna be resolved with a plea deal. but now, they are also facing now two criminal cases. and they have been very aggressive, very litigious, filing off lawsuits against detractors like rudy giuliani and his longtime friend and lawyer rob costello, sending letters to the hill, demanding investigations into congres

do you think carry more risk for hunter, the new tax charges in california or the gun charges in delaware? >> i think these are very serious charges. there are six misdemeanor and three felony. and not only are the tax charges when you look at the indictment, it is not just that hunter didn't pay his taxes, there are also allegations that he tried to defraud the government, that he claimed business expenses for items that clearly were not business expenses, and that he engaged in conduct to try to avoid having to pay taxes on substantial income that he earned during the applicable period. and we've seen other individuals serve jail time for similar charges. so i think these tax charges are very serious and as i stated earlier, any effort to resolve them via any kind of plea agreement seemingly has fallen apart. and we know hunter's attorney on tuesday of this week sent a letter to the special prosecutor asking for a meeting to talk about the charges. and apparently that meeting wasn't held and the suspect prosecutor went forward filing the charges. >> a reva martin, thank you for getting

counsels charges saying that if hunter's last name was anything other than biden, the charges in delawareow california would not have been brought. let's get right over to cnn's evan perez. evan, you broke the story that this was coming down the pipe. walk us through what this lengthy indictment says about where all of this money went. >> abby, what prosecutors do over the course of 56 pages is that they detail what they say was an extravagant lifestyle. hunter biden was using a company that he owns and making deductions for some of the expenses that he was using on his personal life. a lot of it is obviously a very messy personal life, but he has detailed during the time he said he was addicted to drugs. he was paying for escorts, he was paying for luxury clothing, he was paying for, you pointed out that lamborghini, he had used or he had claimed a deduction for 10,000 dollar membership to a sex club. he also, according to prosecutors, spent $188, 000, more than $108,000 on adult entertainment. money that he was paid for women that he was romantically involved with, including one woman w
