he's not a good person. >> that is delvon barnes uncle. he told us today he was not surprised to learn his nephew is accused of kidnapping carlesha. in 2005 barnes was arrested in philadelphia for aggravated assault, criminal trespass, false imprisonment, burglary and reckless endangerment. when he was released less than year ago he headed back to virginia where his parents still live. that's where police say last month barnes abducted and raped a 16 year old. the teenager was found bleeding, burned and smelling of gasoline and remains hospitalized. police in virginia say they're investigating to see if barnes has additional victims. >> well for all the breaks in this case per apartment biggest came when investigators found an image of delvon barnes car and noticed the name of a used car dealer on it when they contacted that dealer he told them the car was equipped with a gps tracker which some dealers do use to keep track of buyers who have bad credit. now authorities used that gps to pinpoint the location of the vehicle. it was at a strip

delvon barnes. we're digging deeper into his background.eyewitness news" reporter steve patterson is at northwest.coms tonight. has more on this as spec. steve? >> reporter: jessica as we were talking to one of the gaither family about delvon barnes and his extensive criminal history he expressed to us he was surprised the guy was on the street in the first play. we did a little more digging into that history tonight. 37 year old delvon barnes has extensive criminal history. he was arrested back in 2005 on charges of false imprisonment, aggravated assault, burglary and wreck less endangerment. he is currently being held on a bench warrant out of charles city council tee, virginia for allegedly capital attempted murder. we spoke to the police commissioner and the fbi on what he faces next. >> he's being currently held on a warrant based out of the charles city council tee virginia sheriffs office for attempted capital murder, assault, malicious injury with acid, explosives or fire. this was from a previous case that he was being investigated

and detectives are still going through evidence from the car delvon barnes allegedly used in the abduction. sources tell fox 29 barnes has given the fbi a full statement. >> i do know that he acknowledged that he did not know her. >> reporter: sloan believes carlesha dropped her phone during the attack on purpose. >> she left it there for us to find. indeed barnes is being look at up and down the east coast in several unsolved cases. tonight investigators tell us that he had carlesha tied up with zip ties in the car. that's why she couldn't get aw away. they will have more information as this investigation unfolds still putting together the investigation and we could see him in federal court here in philadelphia any time now. iain? >> dave, thank you. >>> carlesha and her family are overjoyed that after the harrowing three-day ordeal she's finally home safe. we spoke with her cousin today who said the family is grateful for support from law enforcement and from perfect strangers. >> relief. nobody in my family slept those last couple of days. everybody been up non-stop trying to get her ba

atf agents surrounded the ford taurus carrying 37 year old delvon barnes and gaither. barnes surrendered without a struggle. as agents tried to comfort emotional gaither. >> it happened so quickly that i'm not sure whether she was really, cork process exactly what was happening. she was -- she seemed to be -- she was obviously emotionally distraught. we immediately told her we were the police. you're safe. she was still emotionally distraught. at which point the team asked her what's your name, what's your name? really couldn't understand what she said. so we asked her where you from and she said philadelphia and that's -- we knew it. >> reporter: at that important you knew it was over. >>> absolutely. >> reporter: barnes was the man seen in this surveillance video. violently abducting gaither sunday evening in the city's germantown section. the video replayed nationally and followed by other videos of the abductor led to public tips that help crack the case. baltimore county prosecutor karen, was horrified by the tape of a violent kidnapping in progress. on the other h

philadelphia police say delvon barnes was one bad dude. calling him a serial predator with a lengthy criminal history and were it not for top notch police work, that now infamous video of the abduction seen literally around the world and the public tips it generated this case might have ended very differently. very badly. carlesha freeland gaither's three-day ordeal came to an end wednesday evening when federal atf agents in jessup, maryland, surrounded the ford taurus carrying gaither and her alleged abductor, 37 year old delvon barnes. atf supervisor voice sorry agent jeff matthews was part of the team that took him down. >> we realized we had the right guy. we immediately affected the arrest converged to the driver's side vehicle where he was located. we removed him from the car. >> reporter: but up any kind of struggle at all. >> not necessarily. we removed him from the vehicle. placed him into handcuffs and then turned our attention to the victim in the back seat. the team asked her what's your name? i really couldn't wands she said.
