or the sheriff's department. and that is only with the police department, and not with the sheriff's department, therefore we are not involved in the inception of criminal investigations allegations within the sheriff's department or by their deputies. those investigations are currently handled internally by their internal affairs division. and when they determine that those allegations rise to something that has potential criminal conduct that requires our involvement, then it is referred to us. we're not involved in the investigation. we're not involved in the collection of the evidence. and we have learned from our involvement in the san francisco police department cases that is a critical juncture, where we are able to as assure that the investigation is conducted independently and thoroughly. as attorneys, we understand what is required of us in the courtroom. we go against public defender's office and private counsel all of the time, and we understand the threshold of evidence that will required of us to su

the department's budget. item number three on your agenda is another fema grant, 2017 assistance to firefighters grant award for much-needed equipment. there are two projects for this grander. grant. one is for replacing defibrillators on the fire department trucks. and the second is to replace outdated hydraulic tools on fire trucks. they are used for technical rescues. new units represent increases in improvement and technology and performance and firefighter safety. the total award is about $2. million 7 million, with a matching component incorporated into the department's budget. and the item three is a donation, a roof training prop for the fire department, from j&j roof company. they have donated similar equipment to other bay area jurisdictions, with the goal of improving training. this is a available and realistic train tool for our division of training staff. and i'm happy to answer any questions. >> chairwoman: thank you very much. i believe we have a b.l.a. report on item number three. >> good morn

it is for official departments within the department that those reports can be distribute does, is that right? >> correct. >> commissioner dejesus: all right. so what do you have in place to prevent an employee from e-mailing, copying, or transferring police reports outside the department without going through the protocol. >> other than 3.16, we don't have anything. it's based in those reports and the station itself, we're asking the officers to follow the general orders like any other orders. >> commissioner dejesus: so let me ask you this. photographs. are they taken with a camera, incorporated into the commuter, included in the report? >> so i'll just give you a couple of examples so that it's clear. officers could use their cell phone -- department cell phone. officers could ask to have a snapshot -- sometimes the suspect you're chasing get away. you can take a still from a camera get that. there's a myriad of ways, but there's all relates to the reports that the police department uses. >> commissioner dejesus: and they're all stored through the property unless someone goes through

i think it's a big deal throughout the department and departments nation wide. that being said, i just want to make it clear that in my humble opinion, with all due respect to the chief and everybody that is working hard, this is not the response that i'm expecting. i'm going to keep asking for a state of the art peer support unit now that we're all clear on that. i appreciate all the work thaw guys are doing. but we really need a state of the art peer support unit. so i'm going to look to you, chief, and the next chief and to the extent of the chiefs here and look i said, 120 days didn't bother me because i knew it was ambitious but you have to put a date out there. that's how things get done. otherwise you don't get anything done. i mean generally, not you, chief. unless you put a deadline things don't get done. so thank you so much, chief nickolson. i'll keep asking and i'm absolutely welcome to be a part of this and help out in anyway i can. god knows i've got so much time. and this is a really important issue. so i am absolutely welcome to be a part of it.

other departments, sfpd, department of emergency management, they have their own protocol as well. the current department of homelessness policy outlines what levels of rain, temperatures, and wind trigger the pro fission of additional services. yet shockingly, as far as i understand, none of the recent storms that came with flash flood warnings, cold fronts and high wind warnings were enough to officially trigger the policy and provision of shelter. today, i hope that we can hear how we change these threshholds to be more reasonable and predictable. many other cities like santa barbara and san diego brace their pro cols on forecast of rain probability not inches of rain like we do in our policy. the department setting up shelters and people on the streets can plan ahead and know there's a policy in place and a place for them to go with certainty. it is promising and i want to appreciate that the department of homelessness in many cases, over the last month, enacted their protocols regardless whether we met that standard and indicate a willingness to make changes to their protocol

so before you, it's listed at department bull 19.051. this bulletin was in place back in 2017, and it governs that we can go into the cell phones, department cell phones, computer systems, etc., that the officers and other members -- civilian members do not have a right to privacy in those items. that helps us in our bias audit. since this really moves into 10.08, the current general order, which does not necessarily state that, we are working on 10.08. i believe it's at d.h.r., so they're going to make a decision whether it goes to meet and confer. so this is a patch request to carry us over from our expiration of our last department bulletin which was good for only two years, keeping us through the adoption of the d.g.o., in order to continue our bias audit letting our members know that they do not have a right to privacy. this is just to put the underlying language, the no expectation of privacy which touches on the current 10.08 so we can continue to monitor our communication devices. >> president hirsch: okay. thank you. vice presid

two recent interview by anonymous department of justice sources for abc, in which the justice department sought to make the case that if it chose not to provide these materials to congress, that it would not be a double standard. but make no mistake, it would be a graphic double standard if the justice department decided that dhe public interest merite providing extensive discovery to the congress during the last session, in the clinton email investigation and indeed the mueller investigation, but the public interest did not warrant pursuing so when it came to requests made from a democratic congress on the same topic, or more specifically on the muleer investigation. the justice department sought to distinguish circumstances in two ways. one, saying effectively is james comey's fault. of theond, that because provision of materials even after the mueller report is submitted, the underlying evidence to congress, could interfere with ongoing investigations carried on by other elements of the justice department, the further reason why it sought to adopt a different policy than the one they

the department. it also frankly underscores just how much james comey had -- his firing had to do with russia and how little it had to do with the discovery or statements or information he provided in the clinton email investigation. in june of last year i was notified in writing by the department, the director of the f.b.i. testified in open session around that time as well, that in response to ubpoenas, that all post-data james comey leaving the bureau, they provided those 880,000 documents and that was ongoing. the discovery, probably over a million pages at this point. so this is not something the department can lay at the feet of james comey. it is, i would hope, a decision the department made over the last two years because it felt the public interest demanded it. and that outweighed its normal policy of not providing information in investigations where people are not indicted. to maintain that that is an ironclad policy, well, the department will have to explain that to peter strzok and lisa p
