the department of labor held a national conference, inviting employers, public health folks, and unions. this film came out of that. the film is highlighting the hazards of silica dust and what can be done to control it. the part to me as an occupational health professional, when i saw the film in the late 1990s, was the hazards of silica dust which we were woried about in the 1990s, we're still worried about it today. the hazards were pretty well-known in the 1930s. pretty well identified and documented. what's really fascinating is the control measures of how to stop exposing workersployers could d control with ventilation and other methods. those were incredibly well-known in the late 1930s. they're shown in this film. yet, many employers were still not using those methods in the 1990s, even today, there are employers still not using those methods. so, you know, we had knowledge on both the hazards and the controls. you know, that was 75 years ago, yet, we're still having this trouble. it is clearly not -- a lot of health and safety is not an issue of knowledge and the science. it is

so, i think they'll argue, well, congress didn't give that much power to the department of labor, it was narrower. but the department of labor even regulates oxygen in the workplace. so it's hard to say they can regulate oxygen but they can't regulate the coronavirus. they might say that congress shouldn't have given this power in the first place to the department of labor. but as i said that goes tactualy back to the roosevelt administration where congress, the power was pretty well established. and as you say, jake, the problem with all this regulation is that congress is passing the hot potato. beyond that, i think they can file things. people can file whatever they want. the question is whether it'll go further, and i don't think it will. >> i want to bring in the director of the robert a.levy center for constitutional studies at the libertarian kato institute. do you think that republican governors have a case here that can pass legal merit to challenge president biden's proposed mandate on businesses of a hundred or more employees to have weekly testing or a vaccine? >> well, i'

>> reporter: i think that will be what the companies are asking the department of labor. esting done, also checking to make sure everyone is vaccinated. that's a whole other process and set of infrastructure in and of itself. that has been something we've seen other businesses say, yes, we want to require vaccines, but having the staff to check vaccinations, to make sure that is another separate part of their businesses now since the pandemic has started, part of their life. i think those are details that are going to be worked out. i think that's why we're not getting this rule today. we were told by an administration official they're still drafting the rule and they expect it to be introduced in the coming weeks. also there are questions about the timeline. how long do employees have to be vaccinated or when does this go into effect? we know from the separate executive order the president is signing they are going to have 75 days for federal workers to get vaccinated or risk losing their job potentially. these are going to raise some questions, but i do think this is not

the other thing here is this rule that is still being crafted by the department of labor that is going to require those private companies with 100 or more employees to either vaccinate their entire workforce or of course have them get tested once a week at a minimum, according to this new rule, but this rule hasn't actually been unveiled yet. it is still being drafted at the department of labor. it's not entirely clear still when this is going to go into effect but there will be repercussions for those businesses that don't comply with this and they are incredibly expensive repercussions. this is what the president's coronavirus advisor told reporters earlier about what that could look like. >> a workplace refuses to follow the standard, the osha fines can be quite significant, enforcement actions include fines up to $13,600 per violation. >> reporter: so that's $14,000, almost, per violation which would be per employee that is not vaccinated, and so, victor, we're waiting to see the details of this, though, when it goes into effect, is it the company that has to pick up the tab for th

being able to go back to school safely so to do that, as you say, he's going to roll out the department of labor that's a big piece of this they're going to do through osha here and force every company of over 100 employees to make sure their workforce is vaccinated or tested regularly that's an enormous number of people in this country it's going to affect a lot of businesses and you can expect that a lot of private sector muscle is going to be put behind that effort. the other big piece of that, melissa, is the idea that healthcare workers will be to be vaccinated that they're going to take medicare and medicaid funds from the federal government that is another big stick that the federal government has here, which is to say you can't get these funds if your healthcare workers are not vaccinated and you're not doing everything you can to get that workforce healthy. so two enormous levers right there. then a host of other items throughout here this announcement the president's laying out today as he tries to get that number of unvaccinated americans down the economy and schools back on track. >>

he said the department of labor is going to draw up these requirements.you said, there's probably going to be legal challenges. how long does this play out? are we talking weeks? months? what do you think? >> it's not clearly going to play out overnight. the president said it will take time to have impact. we already know for federal workers, they will have a 75-day window with which to comply. that's two months for federal workers, some 4 million workers are covered by that. i would imagine it would take just as long to cover all of the health care workers -- that's 17 million -- and then another 100 million in private businesses. that may be where we see teen biggest legal challenges. >> sheryl, what could the next steps be? this is a significant enhancement of what he's trying to push and mandate and enforce, you know, but there are some who say he could have even done more like perhaps colleges and other institutions that receive federal funding. he could have a say in that. what else can he do? what else is in his authority to get more americans vacc
