joining us to talk about all of the above is alan dershowitz. great to see you.for joining the conversation. >> thank you. >> maria: what's your take-away on the i.g. report. we heard in the last hour that obviously there was -- it was laced with bias, the fbi in terms of what -- how they felt about donald trump and how they felt about hillary clinton. there was a dereliction of duty with the hillary clinton investigatwhat's your take-away. >> fbi agents are allowed to be biased. they're allowed to support political candidates. that's part of the law. where i draw the line is when an fbi agent says we'll stop him. that's not an expression of bias. that's not saying who we're going to vote for. that sends a message to the american people that the federal bureau of investigation is going to interfere in an election, in an effort to try to stop the election of one candidate rather than the other. i don't understand how strzok can remain an fbi agent after saying, we'll stop that, we'll stop him from being president. that to me is where the red line was crossed. when

alan dershowitz. professor, good to see you again. twice in one day! >> twice in one day, a day for americans. >> it is an important day. and what a historic day in many ways. let me get your reaction to what we heard from mr. ellison there. is this comparable to the dread scott ruling? >> it's not comparable to any of the decisions he mentioned. those all involved american citizens, people who lived in america, born in america. 100,000 japanese-americans, americans put in detention centers, plessy v. ferguson said americans can be segregated. this is about people who want to come into the country and have no rights under the american constitution. so the opinion itself is found as a matter of law. if you pick countries, mostly picked by president obama are the right countries. i much prefer to do it by individuals rather than countries because there are good people in every one of those countries who make great visitors to america. great students and ultimately great americans. i'm opposed to the policy as a matter of principle but the decision is rig

. >> alan dershowitz says that anything that's a presidential power, whenever exercised by the president, by definition you can't impeach the president for that. you two have a sharp disagreement over this for example in the pardon power. professor dershowitz would hold that any use of the pardon power is justifiable and cannot be an impeachable offense. >> i don't know what planet my former colleague is on but he has it upside down and inside out. the whole point of the impeachment power, which has to be used with great care, the whole point of it is to prevent the gross and dangerous abuse of the very powers the president has. if, for example, donald trump is guilty, even now of tax evasion, which does not involve abusing a presidential power, he can't be impeached for that, but if he uses the power he has, like the power to fire the fbi director, for corrupt purposes, that's the whole point of the pardon power. it's just completely crazy to say when you abuse your powers, then you can't be removed from office. i mean, that's what's true of a king, a queen, an emperor, but not of the h

>> when you've lost alan dershowitz, you're really -- you really have a problem. of course he should come out and say that. of course rudy giuliani is not going to say that because what is making him relevant is the fact that people think he's speaking for the president. and so rudy giuliani, i do believe he's lost the step. i believe he's lost several steps actually. but one of the things that he has not seemed to have lost the step on is self-promotion. and so i think that ultimately, again, for him a lot of this is about promoting himself. and not promoting the president. but the president will take it because he is -- the president wants to hear people compliment him on tv, we all know that's a major priority for him. also here, providing that needed distraction. >> you brought up this here, jennifer, talking about the first lady, issuing that statement. we don't hear much from her. you know, it's been mentioned throughout this last couple of weeks that we haven't heard or seen the first lady much. from your sources, your network, what are you hearing about as

so alan dershowitz said of course the president can't bribe witnesses. of course the president can't tamp were witnesses. >> yeah. >> they've said he can do nothing that constitutes obstruction of justice. my view, and the view of many academics in this area and many criminal defense lawyers is he cannot act for a corrupt purpose. that violates his obligation to execute the laws faithfully. >> well, dan, i heard nixon. in my sleep i still hear him saying basically david frost, if i do it it's got to be legal. it sounds like rudy and a whole batch of these guys are saying now, john dowd, a whole bunch of them are saying on a written 20-page argument that the president is above the law. >> they do make that argument. they also make a lot of factual arguments. and i think the important thing for those of us who are concerned about these broad claims is to keep in mind that this letter was written in january. we are now in june. and we're talking still about a potential interview. and that was really the tluts of the letter, was to try t avoid the special co

let me bring in alan dershowitz. alan, you predicted this. you wrote a piece last year, i believe, last march titled why the supreme court will uphold donald trump's travel ban. you're not surprised by this ruling. but explain where you think this goes next. >> the reason i predicted it is you can't have words on paper by a president that are unconstitutional as to one president but would be constitutional as to another president. if president obama issued the same order, you uphold it but if president trump does you don't uphold it. i actually began to wonder if that would be the case when justice kennedy in the case involving the baker who wouldn't provide a cake to a gay couple, the supreme court justice kennedy actually looked at the religious motivation behind the decision of the colorado authorities. and actually did look at what was said by the colorado authorities and used that to strike down in the very, very limited manner the decision of the colorado authorities. so here you have justice kennedy in one case looking at religious mot
