joining me now to discuss this is cnn supreme court reporter ariana devoe.e know about the likely finalists? i've heard four people. i've heard five people, six. >> well, this is the frantic last weekend before the announcement tomorrow. the white house counsel's office has been working on this around the clock. there is a list of four top contenders right now. brett kavanaugh has always been at the top. he's a circuit court judge here. he's 53 years old. he's a conservative with over 300 opinions on issues that the conservatives really like. religion, for instance. religious liberty. but remember, president trump ran on draining the swamp, and he is from washington, d.c. some people are a little concerned about a couple of opinions, so there's other people on the list. another one is ray kethledge. he's also 51 years old. he's been on the bench for ten years. he's considered gorsuch 2.0 because of his philosophy that matches gorsuch and matches a little bit antonin scalia. then we have tom hardeman. he was the number two last time around for justice scalia'

because like nick mulvaney, like betsey devos, he's doing what he promised the american people. he's deregulating the epa. >> i think it's a mixture of things. i think pruitt had supporters among people who said that despite the distractions of the mounting scandals that you can't even keep track of anymore, he was mounting on the agenda that he was put in place to do. to liberals that could even more damaging, to conservatives that could make them feel better about it. but trump himself, pruitt knew how to kiss up to the president. we saw it in the language he used in the resignation letter. i think a lot of this happened in private, that he knew how to flatter trump. and so i think it was the personal relationship, too, that made john kelly have to be the hatchet man here, that trump was dragged along to this decision by his aides. pruitt probably would have hung on longer if trump was left to his own devices on this one for both of those reasons. >> reporting pruitt's sursiefbl came from being the line of eyesight, telling the president he was brilliant and a political revolu

it's the news because betsy devos and the department of education but briefly in 2011, the department of education expand title ix which had been designed to insure protection, equal protection for -- in regards to gender for students on campus which would mean funding for women's sports, so there should be gender equality in all issues related to education. in 2011 it was expanded to clue sexual misconduct. the thinking was was that women students or all students are not going to have gender equality if they're subject to sexual misconduct. so this is created just a vast bureaucracy, sex bureaucracy or sex police it's been called on campus, adjudicating mostly situations about drunken sex between students and faculty caught up in the situations, both because relationships between faculty, romantic relations between faculty to students are prohibited and had sort of mocked regulations about professor-student dating. it spurred me to take a mocking tone about the new regulation. what happened is that my argument in the book is that the level of sexual paranoia is increased so much you
