diane dimond is covering this case for the daily beast and news week.our pulse on something because you have been in that courtroom from you a far it seemed to me that dottie sandusky, wife of, the big gun for the defense, and yet she appears to have corroborated some of the testimony of certain of the boys. in other words, putting them and putting jerry in the same place at the same time. what did you think of her as a witness? >> well, it is obvious that it was dottie sandusky who was the one speaking for the family here. when we learned today he wasn't going to be testifying. she did corroborate some of what the accusers were saying. she said that they did spend the night. they did sleep in that bedroom we heard so much about down in the basement on the water bed. that her husband did go down to say good night to them. not to tuck them into bed as the prosecution kept saying. but she was also strong on saying that never happened, nothing bad ever happened. i would have heard it in the basement. i have good hearing. you know, some of those boys were c

diane dimond with "newsweek" and "the daily beast" is covering this trial in belmont, pennsylvania and michael smerconish is an attorney and msnbc political analyst. tell us today about the testimony of victim one. >> well, this was the second accuser slash victim we've heard from and i'll tell you, you've known me for a long time, chris. i'm pretty hardened when it comes to covering trial stuff, but you know what, i have never seen testimony like this. i'm a mother. i know you're a father. this kid was, is 18 years old. he was 11 when he first met san -- sandusky and the abuse began when he was about 12. alleged abuse, let's say. i got teary, i have to tell you. i got very teary hearing this boy. i call him a boy because he's so small. he's so frail. he walked in with stooped shoulders and his chin down and you just wanted to hug the kid. he broke down completely twice. at one point, the jail matron had to come over and give him a kleenex and frankly, the whole courtroom just sat there waiting for him to collect himself. on two occasions. didn't take any recesses. he just kept talking

joining us now, two people who have been covering the trial from the beginning, joe johns and diane dimond, reporter for the daily beast. also criminal defense attorney mark geragos and senior analyst jeff toobin. is it possible that the government could file more charges again them? >> they have the legal right to say tomorrow that we're going to retry him on those fife counts. i think cooler heads will prevail, this was a very marginal case to start with. >> you say marginal because? >> because it was not a conventional crime, there has never been a justice department prosecution for similar activity. you know, the deterrent effect of this case is negligible because the facts are just so odd, especially in the post citizens unite world where the supreme court is essentially deregulating american campaigns, the idea that they would try to put john edwards in prison again after failing to dramatically and spending so much time and so much money, i just think it's time to closed this shop down. >> the fact that the jury couldn't reach a verdict on five of the six counts, does that tell you
