in fact, he claims that they did not go and alert the dnc, that their computers had been hacked, that they made a phone call and left it on some sort of i.t. help line. here's what he wrote in his op-ed. he says comparing the fbi's massive response to the overblown e-mail scandal, and the seemingly lackadaisical response to the very real russian plot to subvert a national election shows that something is deeply broken at the fbi. comey justified his handling of the e-mail case by citing intense public interest, yet he refused to join the rest of the intelligence community in a statement about the russian cyber attack because he reportedly didn't want to appear political. what's broken in the fbi must be fixed and quickly. tom, your response? >> well, first of all the fbi did warn that the fbi would be briefing the white house continuously through the process of what type of hacking is going on against the u.s. systems, or involving the political process of the campaign. we've seen this repeatedly the hacking of opm believed to be by the chinese. the sony attack by north korea. so you

fbi found out in september 2015 that the dnc was being hacked and they didn't go brief the dnc. can you imagine if that was a republican national committee that was hacked and the fbi didn't fill them in? they would be up in arms. we got to walk in each other's shoes here. this is just an unacceptable assault. >> in terms of walking in each other's shoes, i want to be specific. you mentioned the narrow margin and i assume you mean the small amount that determined the election. we don't have a specific causal that the leaks caused the election. >> i wouldn't go so far as to say definitive but there were many actions in the final days including the actions of the director of the fbi. between not briefing the dnc about the russian hacking, then interfering 11 days before the election has proven himself really in history he'll be one of the worst directors we've ever had, this is an outrageous performance by the fbi. >> what do you say to folks, sean spicer, kellyanne conway and others who say this is sour grapes, you're being a sore loser and attempting to undermine the legitimacy

adam hodge is with the dnc. >> this is unprecedented.tacked the entire democratic party with one goal, and that was to help donald trump. >> reporter: the u.s. intelligence community is split on whether the hacks were intended to help mr. trump, but since at least 2010, u.s. intelligence analysts have been warning of russian cyber intrusions and information warfare. a 2013 threat assessment concluded russia is among three countries focusing on using internet content that might contribute to political instability and regime change. agent first noticed the suspicious activity earlier this year. he called the dnc and was transferred to a help desk. his calls went ignored. it took several months before the dnc realized that it had been contacted by the fbi >> to verify the authenticity of the fbi agent who said that-- that said who he said he was. >> reporter: several months? >> it's hard to believe, but that's the reality. >> reporter: president-elect trump has brushed off allegations that the russians were trying to boost his candidacy. he

essentially, it is a matter of the dnc.'s say i give you diversion and you then a few months later screw up i want to prosecute you. you have not done what you said you would do. i have to then mount a case against you, as i would have months before without diversion. say, i'm going to give you diversion, but in exchange, you have to plead guilty so that if you screw up later, we just go straight to sentencing. it is a lot easier for the prosecutor, but those guilty pleas have a lot of adverse consequences for the defendants. nermeen: the money goes to the prosecutors themselves? >> it is different in every jurisdiction will stop in many jurisdictions, yes, the money goes to the prosecutor and can often be spent on almost any law enforcement purpose, which is very broadly defined. amy: you write that chicago is more successful. >> chicago has a incredibly well thought out program. the person who runs it has a clinical background, not law enforcement background. they have this wide range of available program so that it is re

were overlooked, not followed up by the fbi or the dnc. so the russians had seven months of unfettered access to the dnc computer systems at the beginning of this whole episode. what has this taught us and what concerns do you have? >> let me say what i think i can say. i have tried to be able to tell you the number of times i have received classified briefs and from home. i'm told i can't say that because it's classified. but assume that that's the case. and assume that a gnu of top people have briefed a number of members of the senate. i'm sure members of the house. i can tell you what my belief is. i believe this is an incident of foreign espionage. i believe it is a classic covert operation which russia has performed before on other countries. i believe it is interference in our election and i believe it is an effort to dirty up one of the candidates. that's a quote and that candidate was the democratic candidate for president of the united states. it was e-mails related to democrats that were released to the tune of 18,300 a day over

officials instead messages were left the dnc i.t. help desk. is that accurate? is that an accurate disruption of the outreach that the fbi did to the dnc and if so is that sufficient? >> so as we've talked about earlier this year, the investigation into the hacks at the dnc and d triple c is an active investigation. somebody with a comment on the specifics of how people were contacted, but i can say that the fbi has worked closely with those organizations, both to discuss what we've learned about the hacks to gather information about them so that we can continue this investigation. >> whether or not you can get into specifics is it true that there was this level of calling the dnc that doesn't sound particularly competent or doesn't sound like hit the urgency that one would think. is that basic description that podesta makes? >> this investigation was taken seriously from the beginning. this is incredibly serious issue. i can't comment on mr. podesta's sources or where he gets his information or why he has that view. but he's not inv
