first let's go to the doj where david spunt has details about the department's investigation into mr. george floyd's death. david. >> reporter: arthel and eric, there are two parallel investigations going on right now. one in minnesota, the criminal aspect which we know the officer was charged with manslaughter and third degree murder. at the department of justice headquarters in washington, d.c. is a civil rights investigation to see if mr. floyd's civil rights were violated. that's being held by the civil rights division, attorney general bill barr put out a statement he is very upset about what he saw in the video. in about an hour or so there will be a protest, supposed to be peaceful out here at the doj headquarters. arthel, i want to talk about what happened a few blocks from me last night. things escalated very quickly, six people were arrested, bricks were thrown at people. some secret service officers were injured, we're told that lafayette park is going to be closed today as a result of that. but back to this investigation that's going on here at doj and really across the st

the doj's new standard ignores that. >> justice thomas? >> thank you. , you are about to say how the doj's approach would harm the grand jury. would you finish that? >> yes and i think i was addressing that to justice thomas. to require us in any given case to run across the street to federal court and say by the way, we have an investigation underway, it happens to touch on a president's prior business transactions in which he and others were involved in and we would like to get permission to thata subpoena for records are either in the position of a president or the president's agents -- it completely upends the way a grand jury is supposed to work. the second big problem with the doj's analysis is that the leg which they have chosen does not work -- the language they have chosen does not work. that can only work in a trial subpoena. it calls for stringent showing that it is directly relevant to charging decisions. again, that does not apply in the context of a grand jury window charging decisions have been made. that is why the formulat

so it's an interesting argument that the doj is making to begin with. anytime a defendant removes a case to federal court out of state court, it's a purely strategic maneuver. it could be that this state representative files in a court in southern illinois because maybe he felt he had the advantage. and one thing they did here was take the dispute out of there and into federal court. and is often the case, then plaintiffs fight to get that kicked out of federal court and back down to state court so they can enjoy the forum that they selected. >> so to be specific here, danny, in this case, who has benefited from it being seen in the federal court? >> in this case, the defendant has chosen to remove this case to federal court. essentially the illinois governor is taking this case up to federal court and arguing essentially that it involves constitutional or federal issues. but that isn't always enough to keep a case in federal court. if you are a plaintiff and you alleged only state causes of action, you're saying, look, i don't want my case in federal c

we're going to talk about the filing from doj and some of the specifics. i want your 30,000 foot %-ps dropping this case. >> well, john, the 30,000-foot view is that the department of justice seems to have completely ka p cap it lated the political desires of the president. the fact that they have gone so far as to deny the considerable national security concern that my colleagues and i had about michael flynn in 2016. if i could back up just for a minute and reset this thing. as everyone will remember, the fbi was investigating the russians and the fact that the russians might have been inappropriately intertwined with or coordinating with the trump campaign. we investigated mr. flynn because he had very significant well-known, high-level contacts within the russian government. by the end of december we hadn't found very much new until, of course, we stumbled across absolutely uncon troeable evidence. very simply, he was interviewed about those contacts and given an opportunity to explain why he was talking to the russians. he lied during that interview.

in the court filing, the doj argued that after reviewing its case, including notes from fbi agents that were publicly disclosed last week from flynn's january 17th fbi interview was untethered to an unjustified by the fbi's investigation into mr. flynn and, quote, conductsed without any legitimate investigative basis. the u.s. attorney for the district of colombia added that continued prosecution of this case would not serve the interests of justice. shay was the only u.s. attorney to sign the filing, which drew considerable criticism from prosecutors. the line prosecutors branden van grack withdrew from the case shortly before the justice department argued it could not prove the charges. speaking to reporters yesterday, the president celebrated the news that michael flynn's case had been dropped and accused the justice department under president obama of being treasonous. >> he is an innocent man. he is a great gentleman. he was targeted by the obama administration and he was targeted in order to try and take down a president. a thing like this has never happened before in the history
