the don mcgahn ruling is a point.e left the office the end of last year and here we are almost the end of 2019 getting a judge's ruling in all of this and the justice department saying they want to appeal. talking to legal sources close to the don mcgahn situation, in the last several minutes, this has major implications for mick mulvaney and john bolton and so on and might not have so many implications for john mcgahn because he is not wanted to testify quite as much as he once was. as it relates to the white house and what the chair saying about the what the white house is saying about the don mcgahn ruling as you've been reporting in the last couple of minutes, the justice department will appeal going back to the concern the democrats have had the last few weeks and works to the advantage of the white house. the white house attorney and white house counsel's office and justice department, they can block these administration officials from testifying in these very important matters and it does raise critical separat

we know now this federal judge has ruled a former white house counsel don mcgahn will have to follow the subpoena from white house democrats. we know it stems from the mueller investigation. take us how this could potentially impact the impeachment investigation. >> that's a political question. i'm not sure the answer to that. there's a couple of variables here. number one, yes, the governor has filed a notice of appeal of the judge's ruling. i assume at some point they'll ask for a stay to temporarily stop the effectiveness ruling while they pursue their appeal in the d.c. court of appeals. whoever loses there i'm sure will go to the supreme court. remember how this got started. this was the house judiciary committee asking for don mcgahn's testimony about things that were raised in the mueller report. now obviously the impeachment inquiry has turned in a totally different direction. i'm not sure whether house judiciary still wants him to testify about that or whether they're going to ask him different questions if they have to issue a new subpoena. i don't know how that all plays o

now, in response to this ruling tonight, don mcgahn's lawyer said this, he said, "don mcgahn will comply with judge jackson's decision unless it is stayed pending appeal." and at the time i got on the air tonight the decision had not yet been stayed pending appeal, everybody is expecting it miliky will be. while the trump white house under william barr try to drag this out as long as possible. we'll see how that affects the ongoing investigations and impeachment proceedings on capitol hill and who has to testify despite trump telling them not to. we don't know exactly the timeframe on which this will ultimately be resolved, if as expected the government appeals it to a higher court. woe also don we also don't know whether any of the white house officials currently refusing to testify in the impeachment proceed ings might have been waiting for a court ruling like this to give them some cover. this is a court order that says you have to follow these, obey these subpoena, the president telling you not to is not actually legal lly kosher. the president doesn't have the right to tell you to d

she is basically taking not only the don mcgann question, the question whether it geese beyond don mcgann. it goes on to john bolton and some people in the administration claim even if you make don mcgann. she is saying absolutely not. and then, of course, as you pointed out, she's saying that the president is himself not immune. what does this mean when don mcgann does show up if he does show up? it means that he may still, however, refuse to answer certain questions because of executive privilege. we don't know, erin, how long it will be before this all gets resolved. we know the justice department says they're going to appeal the ruling. we're looking at an appeals court ruling in the next couple of months before it may even get to the supreme court. we're still looking at several months of litigation during which time, of course, the democrats want to wrap up their impeachment inquiry. she's a member of the judiciary committee which will be drawing up articles of impeachment. i appreciate your time tonight. congresswoman, obviously your a right now looking at potential articles when i

what don mcgahn did is cooperate with mueller. indeed, mueller give him a lot of credit for that cooperation. he is more cited than anyone else in the mueller report. on that level, he got a good gray. then he went ahead and fought this fight to not cooperate with the congress. and so this is interesting in that context as i read to you from this judge, siding with pelosi over the trump folks saying the law luau has remained the same from the bush era when then counsel harriet miers did not have absolute immunity to testify, and it remains the state of the law today. and then a professor, this judge write, quote, it goes without saying the law applies to don mcgahn, just as it does to other current and former senior level white house officials. i don't think you need to be a scholar to note that is a big red flag for john bolton, because that is basically saying nobody, not the lawyers, not the national security, nobody has absolute immunity, professor. >> i think it's a big red flag for everyone right now. and if i were in the tr

this is all about don mcgahn's testimony, not anybody else's. remember, we have to step back here to first principles. all the ruling says is that white house employees, and maybe even the president himself, can't just slam the door in congress' face when they're issued a subpoena and say no, we're not coming, we don't have to. what the judge say is, yes, you do. but when you get there you still may be able to refuse to answer certain questions. you can cite executive privilege or something else. that's part two of this which we haven't really talked ability. she does say there's no exception here for people who are talking about national security or anything else. so she sort of dismisses this claim that has been made that the closest advisers to the president or people who are involved in sensitive national security issues can resist subpoenas. it may well be when they get there, they can legitimately claim they can't answer questions about that. this judge's ruling has no legal binding effect on any other district court judge. they're free to

i don't think that don mcgahn's lawyer ever said that. but the bigger question here about this ruling is not will don mcgahn ever testify. because question already basically know from the mueller report what don mcgahn has to say. the repercussions what the question is, does this ruling affect other people like john bolton and will it make them testify. and what i found interesting about this is that it led me to believe that john bolton doesn't really want to talk because this judge's ruling if he wanted to talk, he's been waiting for a judge to rule about whether he should, could have been potentially used as a door opening saying, well, this is in precedent here, the judge even talks about bolton in the ruling, but his lawyer is saying that this does not apply to him and that he had a different role in the white house. and it leads me to believe that bolton will not be looking for a reason to speak in front of congress. >> mimi, there was a win for the president yesterday being specifically the supreme court temporarily blocked the dis
