don trump's team, let's forget about the political issue. just pure facts here, don trump's defense team says that we have been given 800,000 documents, nine months of video footage, there is no trial that has gone to trial from indictment to trial in anything like six months. think of examples of cases that have taken three years and all the doj says, there is sharp language, but they say there's 800,000 documents but we told them which 4000 of the most important. that doesn't count it, you have to go through the mall as a defense lawyer. i should say, even doj is unable to show a single classified document that everyone to trial in six months. >> does trump ever think he's going to trial on this? >> what he is going to try to do is, right out of the trump playbook, delay, delay, delay. we in the action where he is swing you forfeit million dollars. as the plaintiff, we have now asked for his deposition. delay, delay, delay. they want to do it 90 days after the election. but to brings the case and then decides they want to do it in 90 days

>> it is still playing out here in georgia on the premiere battleground states where don trump has a double digit lead over ron desantis in every other potential challenger. the party remains deeply challenged over its fate, including burner brian kemp. another state leader who boycotted the convention, the state party convention just a few weeks ago because donald trump, in part because donald trump was appearing there. and so look, those divisions haven't gone away, at the same time, republicans have shown that they can rally around the flag in a sense. but the same time i want to add to that that georgia is one of those states where there is a defined block of a swing voters that have showed up in 2018, 2020, 2022. not a huge block, but enough to make a difference, enough to swing the state blue in 2020. enough to deprive herschel walker of u.s. and see just last year so, a big number we talk, about two to 3%, but enough to swing the election. that is the electoral block i will be watching. >> indeed, we will see if they continue to be their own worst enemy. fernand, greg, and guy

. >> it was just one month ago that don trump was indicted on 37 counts related to his handling of classifiedial. trump's mar-a-lago judge aileen cannon set the trial date frogs 14th and everyone sort of knew that that is not gonna hold and it's almost certainly going to change. so second council what jack smith said to hold the trial as early as december, but what they'll come back with. their new poll from politico magazine and ipsos's give us fascinating insight into how voters are thinking about this. i found a clear majority of americans, so 2%, think the trial should happen before the 2024 election. take a look at which when we break that out by political affiliation. you see that red column on the left side, that's of your screen almost half of republicans. in fact a plurality of them, i agree the trial should happen quickly. only a little more than a third disagree. on the right side on your screen, roughly the same number of independents think the trial should happen before the election. and when asked about trump's guilt, almost half of all americans said they believe he is guilty o

now is, are you going to make another kind of immediately appealable decision in how you handle don trump's claim that he can let this drag on as long as he wants, including until he is president again? >> and that started the question, kyle, if she comes out with something extraordinarily out of the box, or does exactly what the defense wants her to do, is this immediately appealable again, like what we saw last year? >> something, look at the criminal level, -- particularly how she decides to allow the handling of classified material. i think the government has a lot of ability to challenge some of her decisions on that front. on the criminal level that are not appealable immediately, but the doj will know and knows where all the pressure points are and where they will have the ability to push back on her, , if they feel like she is appearing in that direction. and so i think tomorrow, the hearing, it's a first chance to see her in action in this case. she is not appeared with the defendants or their lawyers at any point yet and so now we'll really get a sense of what the dynamic is like.

this is automatically taking away don trump's primary defense, at least the one he's a ban so far. i think it's really important to understand, big picture-wise, he's putting a really strong squeeze play and on trump's defense team, and i'm very impressed with the speaking indictment as a superseding indictment because the making trump's attorneys earned every penny from that super pac. >> assuming, from that super pac, somebody is paying them. peter, what do you think tonight? >> but it is things that strikes me is hearing the voice of donald trump saying wait the server. i don't know if you remember this, but i remember a lot of a lot from candidate trump complaining about his opponent, hillary clinton, wiping the server in the emails case back then. of course the end, the fbi didn't find anything illegal about that, there was no charges of obstruction of justice in that case. but he made an awfully big deal about the idea of wiping a server. the very idea of wiping a server, to him, as he characterized at the time, signals something wrong, something sinister is going on here. so

grand jury subpoenaed security camera footage from mar-a-lago, including from the basement where don trumpve documents, trump asked to meet with his loyal aide, walt nauta. soon nauta was changing's travel plans to head to mar-a-lago where he read another trump employee, carlos de oliveira, who goes into a closet with another employee who told him that, vos, wanted the security camera footage deleted. when the other employee response he would know how to do that, totally fair, de oliveira insisted that, quote, the boss wanted the server deleted and asked, what are we going to do? that sounds very mob-y to me. it calls to mind the kind of juicy cover details that led to the downfall of another president, richard nixon. you might remember the nixon ultimately resigned after the smoking gun tape was released, where he was her discussing plans to cover-up the break-in at the watergate hotel. but at least nixon had a good sense to try to insulate himself from the burglars who broke into the dmz headquarters. he did not call them directly and asked them for status updates. for more on this histo

despite don trump begging them to come. only a couple of dozen people showed up outside the courthouse that day. i was there that day walking among them and they were less enthusiastic than any new york sports fans. and it was worse for donald trump when he was arraigned in florida. a state that donald trump won. the protest turnout was just as low as in manhattan and much quieter, much more subdued. the so-called protesters were there because tv cameras were there and the protesters were desperately just hoping to get a chance to wave to their friends on tv at home. there have been no real protests of donald trump's arrests. none. no marching in the street anywhere. no noise and at all in all 50 states. donald trump surely realizes by now that if and when he gets arrested and arraigned in washington, d. c., he will set a record low for so-called protest turnout at one of his arrests. virtually everyone willing to go to washington, d. c. to protest violently for donald trump is either in prison tonight or awaiting trial. do
