joining me is prosecutor doug burns. does the president have a point here?a conflict of interest? >> well, there's a little bit from both sides, honestly. it's a political narrative he's driving and they are saying the staff of muellemueller's team - mueller is a well-respected doj. so it is more political theater in my opinion than a legitimate criminal law enforcement point. >> what is his strategy in tweeting the only collusion is with the dems, justice, fbi and russia? >> that's a great question. because i'm not a part of the narrative, dara, but they latch on to and work on stuff about the dossier and whether or not the democrats were behind it. and then the narrative continues on. that's what was presented to the fisa court. and the court wasn't advised on the political aspects of though. and on and on and on it goes. so basically, i'm not a public relations person. i'm not a political expert, i'm a lawyer. but the fact that this is a decided campaign to simply undermine what is going on. he's decided that's the the narrative he wants to pursue, you kn

here now to discuss this is doug burns, he is former federal prosecutor.t go to this judge, t.s. ellis. >> yes. david: he said mueller is indicting people with the sole purpose of getting the president, that is he indicting people in something that is way beyond the scope of the russia investigation just to get them, squeeze them to get them to say something bad about the president. >> the problem he identified, he really gave him a tongue-lashing, manafort was already under investigation in the eastern district of virginia, david, before mueller was even appointed. so the point is the judge calmly said, guys, how did that arise from the mueller probe? david: now he has the scope memo, which unredacted, he can look at whole thing. he can't unfortunately share it with us, but look at himself. >> original scope memo said russia collusion and what developed from it. they went back to the rosenstein for expanded scope incidentally. that is the second memo. judge, a lot is redacted. judge said no, no i want to see it. david: bottom line, if in fact the judge de

joining me is prosecutor doug burns. giuliani is doubling-down on his position that the president didn't violate campaign finance laws. your thoughts? >> well, it is interesting, dara, amid all the confusion that he appears to be creating, i think there's a concerted effort to couple together a legal defense strategy, which is number one. it wasn't a campaign matter because it was an affair potentially embarrassing to the family member. then number two, they backed that up that even if it were, it was paid back. and number three is, we don't know the chronology of when this occurred. but the fact of the matter is that can be muddied up and diffuse the campaign payment notion. that's what this is all about, dara. >> it's amazing they are muddying up what has already been muddied. >> they really are. and it is so interesting because the -- it is clear that i'll flip my analysis a little bit. we made statements on air force one later contradict bid mayor giuliani's at the same time. but again, law is not a balancing test. b
