nbc bay area's monte francis is in downtown oakland with that story for us. monte? >> reporter: diane, good evening. business owners had feared that there would be violence and looting tonight, so they boarded up their windows, just in case. while the protest here tonight was loud and boisterous, much to everyone's relief, it was peaceful. >> the people united will never be defeated! >> reporter: at least 200 protesters marched from the fruitvale bart station to downtown oakland where they blocked the intersection of broadway and 14th. once there, speakers criticized police and held signs that referred to racist and killer cops. >> executing our boys? we wouldn't be here. >> reporter: more than 100 oakland police officers were on hand to make sure there wasn't a repeat of the violence that followed the verdict in the mess seller case when businesses were looted and suffered thousands of dollars in damage. a jury convicted the bart police officer of involuntary manslaughter, and he was sentenced to two years behind bars. mehserle has served 11 months of that sentence

some businesses in downtown oakland were boarded up this morning after preparing for a possible unrest in last night's protest march. the rally was passionate but never got out of control. demtraitors walked from the bart station to city hall. mehserle supporters say he served the same amount of time that anyone else convicted of the same crime would have and pointed out he will be on parole . demonstrators filed a lawsuit against oakland and alameda county claiming their rightts were violated as they participated in protest against the mehserle verdict last november. they represented 150 protestors who claimed that police wrongfully arrest detained them without probable cause violating the crowd management policy. the city is asking for compensation. the staff need to review the lawsuit before they comment. >>> and police officers in san jose have a big decision to sleep on tonight. they must decide whether to accept a 10 percent pay cut and 100 lay offs . it has residents worried. no winners in the new budget. there will be hundred fewer cops on the street. the city is forced to cut

nbc bay area monty francis in downtown oakland with latest for juice good evening. we're here at 14th and broadway and oakland, where the rally got under way 30 minutes ago. you can see there are 200 protesters here, here to express ainger in a widely followed and ashly-charged case. i'd like to show youing else as well. a large police presence. there are several officers here on motorcycles. and they're here to make sure things don't get out of hand. the rally comes on the eve of the expected release of the former b.a.r.t. police officer johannes mehserle from the long county jail. protesters marched here from the fruitvale b.a.r.t. station where grant was killed early new year's day 2009. mehserle convicted of involuntary manslaughter. he served 11 months of the sentence and qualify for an early release, in part because of good behavior. mehserle claimed he meant to use his taser on grant but instead fired his pistol, killing the n unarmed grant as he lay face down an i train platform. >> it's hard to sleep at night and how do you think we'll feel tomorrow morning
