i would not accused dpw of having created a nightmare. this is a new ordinance, but it seems as though no one would suggest this. the appellant thought she fully describe the product she was going to sell. i think it is problematical. i do not think what she is selling is edible food. it seems as though she may require a permit from the police, so that is one problem. another problem is i see no similarity between the coffee and tea being sold there and that being sold in burger king. it is not their principal business. i do not see why that would be any competition. i was little surprise over the uproar of this particular business. this is a unique product. i just assumed i knew the answer. it seems unfair that someone could come in with a much lower cost and compete with those businesses, but we cannot have this kind of food operation within 1,500 feet of a school. it seems there are certain areas of the city where this should be prohibited, and this would be one of them. they could only par for an hour, and the department would require

nuru to be the next director of dpw. with that, i would like to introduce mohammed nuru to you.applause] >> good morning. thank you all for coming out. thank you, mayor. thank you, naomi. ed reiskin, supervisor carmen chu, micro-deputy directors, thank you all for coming out. i am honored and humbled that i have spent to lead the department. i feel really good that we had a very good place with the city's capital planning that was led by mayor lee many years ago. we were able to schedule our projects and were able to pass a bonds. as you heard, with the hospital, we just started work on the cruise terminal where we actually got the team to continue the demolition to bring that project to fruition. we have the new police headquarters down on third street. we have several libraries, market street. we have so many great project. i feel very fortunate to come in with this gift of being able to work with all the public works staff, with the staff from other agencies, mta, the police department, and all these city agencies. most importantly, as the new director, i cannot forget where

i want to thank our dpw construction management team and the inspectors, because they're doing a great job. the reason why this is on time and we look forward to the possibility -- and i always have to say without being too overly exact on updates, but sometime this summer, perhaps towards the end of july, we are looking at the top behalf of this structure -- topping it off of this structure. that is a milestone. the largest bond capital program we have experienced. but one that was a smartly, thoroughly assessed with our capital improvement program and the city, one that i know carmen was proud of in her supportq this and the approach that we have had in how we have approached and how we have build this thus far. and with the kind of modeling that has been experienced and with web corp. and having the design meld with the construction and construction management and getting early input from hospital management is the model that i think well, for generations to come, will be a model i think we will be proud of. because it will give us to honoring the way we use public money, these bond

benefits where dpw becomes aware of circumstances in a recipient's on going case. this proactive approach to combatting s.n.a.p. fraud before benefits are authorized or investigating on going cases to insure only those entitled to benefits are actually receiving them is a critical function of my office. as a best business practice, there is greater efficiencies and denying or reducing incorrectly authorized benefits versus attempting to collect overpaid benefits. in fiscal year 2010/2011 the oig conducted approximately 22,308 field investigations where s.n.a.p. benefits were involved. the cost of taxpayers avoided based on the oig's investigations where s.n.a.p. benefits were denied, closed or reduced was a little over $19 million. not all fraud, however, can be prevented by the oig's field investigation program. when dpw becomes aware of circumstances which affect a recipient's past benefits, it will calculate an overpayment of s.n.a.p. benefits and refer that overpayment to my office, the oig, for investigation. the oig in its fraud investigation program conducts

we got a call from somebody asking, is dpw doing this? we said yes. i have $50,000, i will support it. we are a private group. this is not tax deductible. we do not care. and they rebuilt some houses. the problem with most people is they could not even teardown their homes. but this is the burning man twist. i love telling this story. being who they were, the culture, at the end of each day, the landscape was strewn with debris. you have to seeing the pictures. they gather up the debris, at night, they turn it into a bonfire. that is part of our culture. then locals started to come around and one woman said, i have never seen anything like this. i have never seen anything like this, but i like it. pretty soon, they were making art. fema is not going to do that for you. and that was just a spontaneous effort. now it has expanded around the world. this came out of burning man, this wild, crazy party. >> let us start over here with a question. >> i would like to ask a question about dpw. the people that build infrastructure. i want to know why they do no

there is nothing in the record here to indicate that dpw has done its own investigation. with respect to the like food which is the only basis that i could read in the denial, and does nothing showing, in fact, the finding was made that those entities have food similar to what i believe to be a very distinct type of product that this appellant is attempting to sell. >> i would agree that the process is confusing here, and in the letter, there corresponds with the police officer. it was brought up with close proximity, there is not a lot of detail to support any of that. i am somewhat uncomfortable making a decision either way based on the information we have. i would support a continuance to try to get additional information. i don't know and i can support -- we have to make a decision, but it is confusing at best based on the things we have in front of us. >> based on an issue of due process, i would be inclined to grant the permit, and the think that based on what i have in front of me, my interpretation is that it was denied and based on it being a like food the have e
