is not -- dpw is not going to be issuing the notices. there is a 300' notice requirement and a 30-day, correct? yes. so that is already in place. so again, just what is maintaining is that should the permit be contested, again then again dpw can take into consideration the like food and 300 feet. those considerations are still being maintained. when we initially made the initial regulation, the consideration of the like food within 4 -- 300 feet. i think currently and andres, maybe you can come up to make sure this is clear. it's following the current formula retail requirements. my understanding is that formula retail mobile food vendors would not have to go through the conditional use process there. it's where the conditional use process requirements are set upon formula retail, which is in the n-c districts except for the places where formula retail is not allowed. >> it says before dpw even issued a permit there is a requirement that it be heard at the planning commission and in effect in the practical sense of what they would do, th

if someone objects dpw can consider that. it's a case-by-case kind of thing, where they might say, i'm just again making this up, that there are already three chinese restaurants around here and we don't think it would be good to put a chinese food truck there. so they can take that into account and require a certain buffer. this would say they can still do that, but regardless, it has to be at least 50'. so the two are not really inconsistent. it would be presumptively 50' at a minimum. but there might be some circumstances or based on the specifics of the area and whatever dpw takes into account; that in terms of making sure there is fair competition. that a higher buffer would be required. >> okay. thank you. >> director dick-endrizzi? >> and i just wanted to also note that dpw is here, if you have questions of them. >> commissioner white? >> quick question that might be covered already. what happens if there is a brick an mortar vacancy and the new space comes in to be a restaurant and the mobile food truck already has a

it might take dpw hours to get out there. they don't have enough enforcement staff and the food truck is gone already and if they do catch the violator and issue a notice of violation, those are very challenging to enforce. so what this legislation will do is authorize mta and parking patrol officers on behalf of dpw to issue a citation to a food truck that is violating its permit or has no permit and pos are a little bit more effective than in some other city enforcement functions and quicker in getting out there and enforcing and the ticket can then be enforced through dmv through the vehicle. so it's a much more effective way of enforcing. commissioners this package of legislation resulted from more than a year of work with various stakeholders and interested parties who were often in conflict. we did our best to navigate a middle path and to take fevering into account and come up with a set of rules that would work for the city. there are new restrictions that did not exist before for food trucks and there are loosening o

we've got bart, we've got dpw. i see sfmta as well as tjpa. then i see a small nonprofit group. is there some kind of weighting of the scores or is everyone on equal footing in this application process? >> [speaker not understood] actually have to be an eligible applicant to apply. you have to have what's called a cooperative master agreement in place with the state department of transportation. this particular nonprofit does not have that agreement, so, their project would need to be sponsored by an agency that does have this agreement, mta, dpw, the port. >> right. >> dph. we have been working with this agency, the executive director of api and also the mta, to figure out what's the best way to move the scope of this project further either integrating it into mt's existing old program curriculum and outreach, or whether there needs to be a stand alone project. we're also in communication with dph on this issue. we're trying to figure out what's the best way to move this project forward. >> okay, good, i'm glad to hear [speaker not understood]. i'm under the impression apri has

you know, i applied with the dpw last november. that is when i started the permit process and i was given a hearing date in april. you know, i got my health and fire department permits granted in april of this year. and then my hearing went kind of went off without a hitch and i was granted permits by the dpw. unfortunately the permits were appealed bit rincon center group and lasted until august of this year. i think the point i'm trying to make here is from start to finish to get my permits in place was ten months. and as a small business owner it's such a long time. and i know there is a backlog of so many other things that the dpw deals with. it's just my hope that this new legislation will help streamline the process going forward, and really shorten that time period down for everyone. >> great thank you very much. >> thank you very much. >> [ reading speakers' names ] >> hi commissioners i'm an owner and operator of tres tequila lounge. we have been open as a brick-and-mortar restaurant for seven years in the soma district by
