dr. macneill had a plan.was a plan to push his wife to get a full facelift, and when she's all bandaged up when she comes home, to force her to take pills that would ultimately kill her. prosecutors say he went to a plastic surgeon, asked for more medications than you would normally get when someone has a fa facelift, and that first night after she came home, told daughter alexis, go to sleep, i can take care of your mother. the next morning, alexis found her mother, almost incoherent, later that day, michelle said he just kept forcing me to take pills that i threw up. ten days later, she was found unconscious and unresponsive in the bathtub. as dr. macneill was trying to perform cpr on her, he was also yelling and screaming over her body. >> why did she have the surgery? why did she take all those medications? i told her not to do it. i'm a doctor. she's dead. i have been a bishop. i paid tithing. and this is the way you repay me? >> and the prosecution also said that during the surgery and during the funera

dr. macneill went to the hospital. the question is, on april 11ed, the morning she was found in the tub, what is the prosecution's theory going to be. here are the facts. they are that alexis spoke with her mother, she seemed fine and was optimistic. dr. martin macneill made his last phone call at work at 9:30. he then went to the safety fair at 11:00. when did he have time to kill his wife? prosecutors said yesterday out of the presence of the jury their theory on when he killed his wife. listen to this. >> the theory of our case is that he was able to leave work, go home, kill michele, and return to work in time to receive that award. and that part of his being so adamant about being in the photo is his intention to establish the alibi. there's a picture of me here at work. and we think that part of our theory and part of our argument is intended to show that that -- that insistence that he made on being in the photograph was actually part of the plan that he developed to obstruct the investigation and to establish t

dr. macneill forced his wife into having this face-lift. i thought that he just persuaded her to.d not to have the surgery. her attending physician told her over and over, her blood pressure was too high. following this consultation, and there were witnesses to this, the defendant turns to his wife and says, i've already paid for the surgery, we're going forward as scheduled. his wife, now dead, went on and on how she wanted to lose a few pounds to get her blood pressure under control. the doctor would not let her. i also heard about the morning that michelle macneill died. i heard about all of the conflicts in testimony. and i heard the way that dr. macneill, according to prosecutors, carry on in front of the emts and neighbors that were there, about how he begged his wife not to have the surgery, that she clearly overdosed on medication, medication that he insisted she had. i heard about her older daughter, alexis, who is a medical student, how she left her dad alone with her mom for just a few hours, came back, and she was oversedated and unconscious for an entire day. at that

dr. macneill and his wife were in it, doesn't it? >> absolutely.e is bandaged from the plastic surgery, so she can't actually see the pills, so she's found semicomatose by the daughter, the daughter later talks to her when the wife is able to speak, and she says that her husband was giving her excessive medication, and she asked the daughter to show her pill by pill so she could recognize what they are so she could independently confirm what medications she's getting because she can't see. and she expresses fear that her husband's trying to make her overdose. jon: alexis also testified, tom, that her mother told her that she believed her father was having an affair at which point alexis herself pays for one of those call-tracing services, and they come up with the name of this gypsy willis who, lo and behold, becomes the family nanny after the mother died even though one of the children testified that, basically, as a nanny she didn't do anything. now, i just have to think that if it walks and quacks like a duck, this jury is going to find a duck.

dr. macneill here. so what does it mean? social it mean it's a tough case to make? >> not in this case. case, i would reverse it and say i have no idea why it took them so long. they had enormous evidence against him for a long time. he was serving three years already, for stealing the identity of his adopted daughter. i don't think the authorities felt they had to rush this. but you're almost trying to -- trump me, because you're saying, wait a sec. exactly. this is one of the most bizarre cases i have covered. i do not say that lightly. because of the amount of things they have against him. it seems everything in this guy's life was a lie. he lied about his degrees. he lied about having cancer. he stole his daughter's identity. it goes on and on and on. and then, you have this bizarre allegation that he's forcing his wife to have a face-lift because -- so he, as a doctor, can overprescribe her with drugs, kill her, so he can be with his mistress. and it won't be discovered. the authorities have had all of this for a long time. i can't give you an explanation why it took so long to cha

testified on how they saw an unresponsive michele macneill in that bathtub and what it was actually like to be right next to the frantic now defendant drill neighbor kristi daniels described the tragic moments after michele macneill was found in the bathtub. she had been summoned to the home by the daughter ada. >> i started running and went into the house and followed martin's voice and when i came in to the bathroom, i could tell that we needed to call 911 so i said i'll call 911 and he said i've already called 911. >> we have here in front of us the bathtub. >> reporter: prosecutors brought in a bathtub, similar to the one found in the macneill home so they could demonstrate how michele was found. daniels said she was lying face up, her head at the faucet, feet inside the tub with her husband draped over her head. she said there wasn't any water in the tub. neighbor angie aguilar will testified and did not appear to see any actual attention to revive his wife. prosecutors say macneill forced his wife to have a facelift, supplying her with several different drugs all so he could be with his mistress. macneill is charged with murder a

. >> reporter: the latest in the case, started with 50-year-old michele macneill being rushed to the emergency room. dragner examined her. macneill was declared dead a short time later. the mother of eight left behind a husband of nearly three decades, now on trial for her death. wagner testified that macneill made an unusual request in the e.r. >> he offered me money to continue my resuscitation and not quit. >> reporter: prosecutors say he gave his wife a deadly dose of prescription pills. his attorneys say michele macneill died from a heart problem. they also heard from the girlfriend of their son, damian. >> at the time, it did seem strange, yes. >> reporter: this morning, macneill is expected to come face-to-face with his daughter, rachel, when she takes the stand. she has long believed that her father is guilty. speaking about the case in 2012, on "20/20." >> you just wake up. and you try to do what you can. and it's living a nightmare. >> reporter: another key family member who could take the stand today, little eda macneill, who was 6 when she found michele unconscious in the bathtub. this morn

dr. todd gray. the initial cause of death was ruled as natural causes of michelle macneill, saying her heart diseaseilled her. it wasn't until the macneill children pressed the authorities to do a more thorough toxicology report, they found out she may have had a lethal cocktail of drugness her system that could have exacerbated the problem. now listen to the prosecution's new line offing to the medical examiner. >> if you were to learn that the defendant here had told somebody or others that he had drugged up michelle macneill, and convinced her to get into the tub and held her down for a little bit, and it caused her death, would that see see anywhere -- scenario be tint how michelle macneill may have died here. >> yes, certainly is possible. >> reporter: not just giving her the drugs but actually holding her down and drowning her. that medical examiner will be cross examined in four or five minutes. >> we'll watch for that. >>> some coaches will apparently do just about anything to win. but wait until you hear how a few in louisiana are accused of getting their hands on the too team's playbook, a

macneil was drugged and drowned. defense heart disease. the medical examiner cause of death is undetermined. pathologist dr. michael baden joins us.e to see you, sir. >> hi, greta. >> where are we on this death? was it murder or not? how does a jury sort this one snout. >> well, the district attorney feels it's murder. part of the problem is that three forensic pathologists have examined the body or the records. two for the state of utah and one for the family. none of them have come down with a manner of death being homicide. the part -- other part of this question is that normal adults, whether healthy or not healthy do not die of natural causes with their clothes on in the bathtub. it doesn't look natural. there hasn't been proof, scientifically that it's murder, but the district attorney must have a lot of evidence to put this forth without a homicide or murder classification by his own medical examiners. >> have you ever seen a trial or heard of a trial where there is a conviction where there was no medical examiner testifying that the cause of death was a homicide? >> it can happen. but it's very hard for district attorney t

macneill just losing it and screaming and then hanging up. let's play it again. >> there was no water in the bathtub and michelle's hair is not wet. >> dr.w pointed out that medical professionals are trained not to hit the panic button. they don't have a panic button the way the rest of us do. i think that is interesting. at the same time we get in dangerous ground when we talk about how i would act during a 911 call. everybody reacts differently in times of emergency and god willing you don't have to go through it to know how you would behave on a 911 call. but this case is heavy on suspicious behavior by this doctor but light on the science. that's the prosecution's biggest problem. >> you're right about that. and the way that news people handle it as well. my friend is an e.r. doctor and once he actually had a reaction and he was like i want you to go do this and i would be like what do i do? you're right about that. mark geragos, macneill's two oldest doctor say that he insisted that his mom get the facelift. but when she was found dead, neighbors say he was saying, well, why would you do this because of all your stupid surgery? isn'
