i want to start with health and human services nominee dr. tom price. you look at tom price, he is not on the list as of yet for confirmation hearings. we don't have the date yet. we do expect him, of course, to be facing the senate at some point. he wants to block federal funding for planned parenthood. the group is planning some rallies nationwide in protest. how much do you expect here, shane, when you do look at this, that the fight that will happen in the streets through these protest also spill over into the confirmation hearings because of that threat of defunding planned parenthood? >> absolutely there will be spillover. not just for jeff sessions and tom price but all his nominees, rex tillerson, nominee for secretary of state. there's a basic fact here. republicans have control of the senate with 52 seats and they only need 50 votes in order to confirm any of these nominees if mike pence serves as a time breaker. democrats start behind the eight ball here and are challenged with price, sessions. maybe not to block them from getting confirmatio

critical nominations today but today democrats slammed on the brakes on steve mnuchin's nomination and dr. tom price to be the next secretary of health and human services. republicans on the finance committee are calling this unprecedented and top republicans are accusing democrats of throwing an hissy fit. >> i think they're dragging their feet. they're going to delay as long as they possibly can. then they're gonna complain the trump administration can't govern. >> reporter: also in a bit of limbo, senator jeff sessions nomination to be our next attorney general. the judiciary committee will try again tomorrow morning. there is some suggestion that president trump firing of the acting attorney general has made democrats here on capitol hill a little feisty. >> what are democrats saying about these delay tactics? we just heard from sean spicer. he said senate democrats are trying to stall core functions of our government. what are the dems saying? >> reporter: democrats are essentially recognizing they don't appear to have the votes to defeat any of these cabinet nominees so their strategy ap

mnuchin's nomination to be treasury secretary and dr. tom to be health and human services secretary. it means that donald trump would have to recess appoint these two nominees, avoid the senate altogether and directly install these cabinet nominees when the senate goes on their recess which the president is allowed to do under his constitutional authority. it's something that presidents tend to avoid doing as well because there's some limitations to the extent these members, these officials can stay in office if they are recess appointed. we don't know if democrats will eventually acquiesce and eventually attend these committee votes. they are saying they want more information from congressman tom price. they say he was not forthright with the committee during his testimony. similarly with steve mnuchin who has sort of been wrapped up in this as well because of committee votes on both nominees. we'll see how this plays out. for right now, the last week could be a recess appointment. >> at a standstill at the moment. and you say the democrats
