in 2018, the drug enforcement administration took the unprecedented step of placing all fentanyl-relatedces -- also known as fentanyl analogues -- on schedule 1 under the controlled substances act. that makes it easier to prosecute any individual who sells or simply possesses fentanyl analogues and subjects those individuals to stiff mandatory minimum penalties regardless of individual circumstances. typically, a drug is only added to schedule 1 after the department of health and human services conducts a scientific study to determine if it has a hypotension for abuse and no accepted medical use. the d.e.a. has temporary authority to bypass this process for two years. the authority was scheduled to expire february 6 last year, 2020. the d.e.a. warned us of dire consequences if it expired. in response, i worked with senator lindsey graham and senator feinstein and authored legislation extending the authority for 15 months, until may 6, 2021. so what did the trump administration do for the 12 months that they were in office with this issue still looming? nothing. and neither did congress.

enforcement officials on the border have allowed for the importation -- the free importation of drugs like fentanyl and heroin across our border. due to those failures, it is understandable why the previous administration instituted a policy that required the enforcement of our laws. for four years, we listened to members of congress have these discussions on the border and in the halls of congress about the misfortune of those who've crossed into our country without the benefit of citizenship. but what exactly does it mean to put forward a zero tolerance policy? it means enforcing the laws and giving needed support to our frontline border officials. no one wants to see a child separated from their parents. this is a problem that congress needs to fix. this is a problem that congress can fix. to understand why this has happened, we look back to the court case of reno vs. flores in 1997. we look at the asylum laws that were passed late in 2008. the flores settlement prohibited the detention of children from a noncontiguous country for more than 20 days. after those 20 days, they are placed in the care of the office of refugee resettlement if they cannot be met up with am if aly. -- met up with family. b
