the trump administration withdrew that dryden -- withdrew that guidance. these cases have been decided increasingly under the 14th amendment's equal protection clause rather than under the statutory regime, thinking about title ix. and so, justice kennedy never wrote an opinion involving transgender people. but he was of course, the court's most vocal proponent of equality. many people of course, would see these issues as being like. we don't know what justice kavanaugh is going to think about this issue, but he may well not be as protective of lgb ts youths as kennedy was. the other area that i would also keep an eye on as potentially changing, would be, respect unauthorized on immigration. there is a case from 1982 called feiler versus doe, were a texas sought to exclude unauthorized immigrants from its public schools. good supreme court of the united states invalidated that measure. it obviously violated the constitution. john roberts, when he was a young attorney, working in the reagan department of justice, wrote a memorandum, suggesting that that cas
